‎● Sometimes 'kufr' is used as 'minor kufr' and not 'major kufr':

"Then we caused to inherit the Book those We have chosen of Our servants; and among them is he who wrongs himself, and among them is he who is moderate, and among them is he who is foremost in good deeds by permission of Allah. That [inheritance] is what is the great bounty."
(Faatir 35:32)

All the three are going to jannah🌷, therefore the dhulm here means minor kufr.

‎● Fisq can also be used as 'Kufr' like in the ayah:

وإذ قُلۡنَا لِلۡمَلَٰٓئِكَةِ ٱسۡجُدُواْ لِأٓدَمَ فَسَجَدُوٓاْ إِلَّآ إِبۡلِيسَ كَانَ مِنَ ٱلۡجِنِّ فَفَسَقَ عَنۡ أَمۡرِ رَبِّهِ

"And [mention] when We said to the angels, "Prostrate to Adam," and they prostrated, except for Iblees. He was of the jinn and departed from the command of his Lord."
Here fisq here is kufr.

‎● Fisq can also be used for believers. It is sometimes used as a minor or major like in the ayah:

"And those who accuse chaste women and then do not produce four witnesses - lash them with eighty lashes and do not accept from them testimony ever after. And those are the defiantly disobedient,"
(Surah Noor 24:4)

The fasiq here means the minor, the ayah is talking about the believers who did it.

There are other terms that have been used in the Shari'ah in place of kufr and they take the place of kufr.

‎● Shirk is used as kufr, like in the story of saahibul jannatayn:

وَأُحِيطَ بِثَمَرِهِۦ فَأَصۡبَحَ يُقَلِّبُ كَفَّيۡهِ عَلَىٰ مَآ أَنفَقَ فِيهَا وَهِيَ خَاوِيَةٌ عَلَىٰ عُرُوشِهَا وَيَقُولُ يَٰلَيۡتَنِي لَمۡ أُشۡرِكۡ بِرَبِّيٓ أَحَدًا
"And his fruits were encompassed [by ruin], so he began to turn his hands about [in dismay] over what he had spent on it, while it had collapsed upon its trellises, and said, "Oh, I wish I had not associated with my Lord anyone."
(Al-Kahf 18:42)

Shirk is part of kufr, here the person did kufr and not shirk. Both words can be used interchangeably sometimes.

‎● Sometimes kufr is used but it means dhulm (ظلم) like in the ayah:

وَيَوۡمَ يَعَضُّ ٱلظَّالِمُ عَلَىٰ يَدَيۡهِ يَقُولُ يَٰلَيۡتَنِي ٱتَّخَذۡتُ مَعَ ٱلرَّسُولِ سَبِيلًا
"And the Day the wrongdoer will bite on his hands [in regret] he will say, "Oh, I wish I had taken with the Messenger a way."
(Furqaan 25:27)

The dhalim(wrongdoer) here means Kaafir. Ibn Taymiyyah said: "The dhaalim here is the Kaafir who never believed/followed the messenger ﷺ and also the believer who partly followed the messenger ﷺ (minor kufr)."

"We are most knowing of how they listen to it when they listen to you and [of] when they are in private conversation, when the wrongdoers say, "You follow not but a man affected by magic.""
( Al-Israa 17:47)

The dhalimoon here are the kuffaar because this came down on the kuffar of quraish.

🔘DEFINITION OF KUFR

Linguistic meaning -
to conceal something/to hide something

Technical(Shari'i) meaning - there are many different definitions:

- given by Al-Azhari, he says: kufr is the opposite of eemaan.
- Al-qaraafi: asl of kufr is to destroy or eradicate a specific type of Rubūbiyyah either with ignorance, like throwing the MusHaf in the bin, prostrating to an idol, going to the church always, dressing like the christians, not believing in what one should believe in etc.
- Al-kafawi: not believing in that which he should have believed in.
- Abdulrahman Nasir as si'dī: stubbornness to submit that which the Messenger ﷺ came with.

✔️The Most Correct one- Anything  that is in DIRECT opposition to asl al eeman.

💢TYPES OF KUFR:
1) When the Shari'ah uses the word 'kufr' unrestrictedly;
The 'ulama divided it into two:

(i)Kufr Al Akbar(Major Kufr): anything that opposes the asl of eeman.

Allah said:
".....If Allah had willed, those [generations] succeeding them would not have fought each other after the clear proofs had come to them. But they differed, and some of them believed and some of them disbelieved. And if Allah had willed, they would not have fought each other, but Allah does what He intends."
[Surah Baqarah: 253]

(ii) Kufr Al Asghar (Minor Kufr): That which opposes kamaalul waajib;

like the statement of Allaah:

ومن لم يحكم بما أنزل الله فأولائك هم الكافرون
"And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers"
[Maaidah:44]

Ibn Abbas said, here 'kufr' means minor kufr and not major kufr, the same was said by Tawuus.

Ibn Taymiyyah said:
"Ibn Abbas and many others from the salaf said that this is kufr dūna kufr[kufr before major kufr] and [in the latter aayaat the fisq mentioned means] fisq dūna fisq [fisq before major fisq] and dhulm dūna dhulm [dhulm before major dhulm]."
Imaam Ahmad and Imaam Bukhari said the same.

🍂THE REASONS THAT ALLOW THE SPREAD OF THE TAKFEERI IDEOLOGY:

1) Ignorance of the religion;
if you see Syed Qutb, you will never find a chain of scholars. You will find that their upbringing and background have no relation with scholars and their knowledge.

Ibn Taymiyyah said:
The issue with the innovators is that their problem is compounded with 2 things:
- ignorance of religion
- oppression
They innovate an innovation that opposes the quraan, sunnah & the ijmaa' of the ummah; and then they make takfeer of those who oppose them(in this innovation of theirs) ❞

2) Following the desires, turning away from the nusūs(textual evidence). They will never say (Allah said & the Messenger ﷺ said)

3) False and corrupt interpretation of the texts. Even if they bring something from Quraan and sunnah, they will interpret it in a faasid(corrupt) way.

🖋Ad DahHaak Al Hilaali rahimahullāh said:
❝The people of Nahrawaan (i.e, khawarij) took verses that were revealed for ahlul kitaab and placed it on the Muslims.❞
Even the tabi'een had a hard time with these people.

4) Deceptions of shytaan.
Ibn al Jawzi said:
The trickery of iblees is on these individuals who did what they wanted to do in their situations and they believed that Ali ibn Abi Talib is upon mistake, and they started to believe that muhajireen and ansaar who are with Ali are upon mistake, and they(the khawarij) are upon the truth;
And they made the blood of the children permissible for themselves(i.e, to kill them);
(although) they believe it is impermissible for them to eat what has fallen from a tree(because it is someone else's wealth & not theirs) .
🚨THIS IS THE TALBEES(DECEPTION) OF IBLEES.

⚡️SPREADING OF THE IDEOLOGY OF TAKFEER WITHOUT EVIDENCE IN THIS UMMAH:

This is from the earliest deviations, the i'tiqaadi bid'aah of the khawaarij- the first group that takfeered the muslims without known evidence.

The khawarij also made takfeer of the noble companion- Ali ibn Abi Talib
All of the groups of the khawarij believe that every sin is major kufr except Najdat(a group among the khawarij).

🔥Takfeer has spread greatly and the biggest reason that allowed this to spread in the midst of the Muslims is: some of the groups that give da'wah at this particular time were not nurtured upon sunnah. Some of them have ignorance or intentionally do it.
There are individuals whose books are excessively read and takfeer is apparent in their works, such as, Syed Qutb. He made takfeer on a large scale.

He says: ❝Verily the people are not muslims as they claim and the people are living a life of jahiliyyah;
and if someone wants to deceive himself or others and wants to believe that it's possible for him to be upon islaam with this jahiliyyah (he meant kufr Akbar )
; (then) his deception does not change the reality, this is not islaam and these individuals are not muslims.

He said the following in his book- Dhilaalul Quraan:
The time has come around like the day when this religion came, the mankind has APOSTATED, they are going back to worshipping slaves and the oppression of religions and they TURNED AWAY from what la ilaha illa Allaah is, ALL OF MANKIND.❞
(May Allah forgive Syed Qutb for this mistake).

Even the ikhwanul muslimeen have accepted that his books are filled excessively with the takfeer of the muslims.

WHAT IS THE FUNDAMENTAL ROOT OF THE GROUPS THAT OPPOSE THE AHLUS SUNNAH

It goes back to one point: if you look at the Murji'ah, Khawarij and Mu'tazilah, they believe that the eemaan is ONE component, & that it cannot be broken into asl, kamaalul wajib, kamaalul mustahabb.

Khawaarij & Mu'tazilah believe if some of the eemaan goes then all of it goes;
and Murji'ah believe if some of the eemaan remains then all of it remains

• Khawaarij & Mu'tazilah have a problem in their definition of ‘who is a kaafir’ and the Murji'ah in ‘who is a muslim’

🔴THE DEVIANT SECTS⚠️:

✖️AL WA'IDIYYAH
They have only taken the verses that show wa'd(punishments).
They are two groups:
•MU'TAZILAH and the
•KHAWARIJ.

Both of their beliefs are the same. They both believe that eeman is Qaul and Amal.
The problem with them is that they say ALL of the speech and ALL of the actions are asl. So if you leave ANY action, then you are a kaafir.

The only difference between the khawarij and mutazila is the name calling in it.
The khawarij will call a person ❛'kaafir❜ but the Mu'tazilah say, the person is neither a mumin nor kaafir(منزلة بين المنزلتين- he is in a station between the two stations)، but he will be in hellfire forever.

Different Sects within the Murji'ah:

➤ Jahmiyyah: They say eemaan is just ma'rifatul qalb, it just needs to know(about the Oneness of Allah etc).

➤‎ Al karraamiyyah: They say that the eeman is only the speech of the tongue, not belief in heart nor actions. For them, anyone who says shahaadatayn is mu ’min with complete eeman.

➤ Murji'atu fuqaha: They say that the eeman is speech and belief in the heart but not the action. -They reject the different levels of eemaan.
Abu Hanifa is from them, he fell into this problem. Hammad Ibn abi sulayman was the first to bring this belief to kūfa.

🔴THE DEVIANT SECTS⚠️:

✖️MURJI'AH
- The backbone of them is that they take ‘actions of the limb’ out of eemaan. They say 'amal is not a part of eemaan.
- to them the eemaan is ONE component, it is either there or not; they don't believe in the branches of eemaan.
- they say eeman doesn't increase or decrease.
therefore they say Abu bakr's eeman, jibreel's eeman, and an alcoholic's eeman are the same. This is from the asl(foundation)  of the manhaj of the murji'ah.

‎They are called Murji'ah because irjaa' comes from the word ta‘kheer(delaying). They delayed or actually took out the 'action' from eeman

🪴WHAT IS EEMAAN

Eemaan is - belief of the heart, speech of the tongue & actions of the limb.
Imaam shafi'i & imaam bukhaari transmitted an ijmaa'(consensus) in this regard.

From the methodology of ahlus sunnah- eeman increases with obedience and decreases with disobedience.

There are 3 branches:
1)Asl/ the foundational branch of eemaan:
if asl is not there then you are no longer a believer, you left the fold of Islam.

2) kamaalul waajib/the obligatory branch of eemaan: if you leave this, you don't leave the fold of Islaam but you are in a serious situation.

3) kamaalul mustahabb/the recommended branch of eemaan: this does not cause you to leave the religion, but it makes you lose the completeness of eemaan.

Allah azzawajal did this categorisation in the quraan, He said:
"Then we caused to inherit the Book those We have chosen of Our servants; and among them is he who wrongs himself, and among them is he who is moderate, and among them is he who is foremost in good deeds by permission of Allah. That [inheritance] is what is the great bounty."
[Surah Fatir:32]

• the one who wrongs himself has aslul eemaan but not the other two.
• the one who is moderate has aslul eemaan & kamaalul waajib but not kamaalul mustahabb.
• the one who is foremost in good deeds has all three🪻.

🫧Ahlus sunnah wal jama'ah differed among themselves in: what is part of asl ul eeman? What can take the person out of the eeman?
Is the salah part of asl ul eeman or kamalul waajib?

Imaam Ahmad made takfeer of those who left any of the four pillars (After the shahadatayn- which are - salah, zakah, saum and hajj)

Ahlus sunnah did takfeer on people who left salaah and other pillars. [shahaadatayn is from asl ul eemaan-this is agreed upon.]

ANYONE WHO MAKES TAKFEER OF A PERSON OTHER THAN FOR LEAVING THE 4 PILLARS IS OPPOSING AHLUS SUNNAH WAL JAMA'AH.

RULINGS PERTAINING TO TAKFEER(LABELLING SOMEONE A KAAFIR):

📌Some important points:
1) The Messenger ﷺ said, if a man says to his brother "ya kaafir", this statement of his will go to one of the two.

2) if a brother throws the word fisq at a brother or throws kufr and if he is not, it will come back to the one who said that.

3) when the ahlus sunnah came across the severity of these ahadith they added it to their books of i'tiqaad, chapter known as asmaa wal Ahkaam, names and rulings like the names, kufr, fisq, bidaah;
as these are just not simple names, there are Hukum, rulings come from it.

4) saying Allaah will never forgive you is takfeer.

5) ahlus sunnah always warned against takfeering without evidence and proofs.

Abdul Latif ibn Abdil Rahman(great grandson of Muhammad ibn Abdil Wahhaab) said,
labelling a person as a kaafir and takfeering on someone who is a muslim from dhahir (apparent), then you are making takfeer without any legislational evidence. This action of this individual is not positioned towards the people of knowledge. It is the path of people of innovation. It is an indication that he(the person who is labelling) has no Taqwa and khashya of Allaah

⚠️ From the foundational beliefs of khawaarij is that they make takfeer of the people who rule by other than what Allaah ordered in an unrestricted way. They are making a takfeer of something that is not kufr-al-akbar. You cannot make something wajib/haram based on your hawa(desires).

✖️The first deviation that occurred is the bida'h of the khawaarij, when they left the leadership of the noble companion, Ali ibn Abi Talib.

The Prophet ﷺ said,
"forbearance(حلم)comes from practicing."

• Allah described mankind as "extremely oppressive and extremely ignorant".
is that the description of the people of jannah? No.
At some point we need to get out of that character, therefore we need to learn good character.
None can come and say "I'm naturally an angry person" or "I'm naturally a stingy person"

You can learn to GET RID of these.

What has been compiled regarding imaam Ahmed's views in Fiqh ?

His views in fiqh were compiled in the form of fatawa that he would give. These fatawa were recorded and compiled by his students. The people of legal questions were more than one hundred individuals. Among the legal questions of imaam Ahmed that are published and still exist to this day is masail imaam Ahmed by Imaam Abi dawud. Abu Dawud was one of his students who recorded both his views in fiqh and questions related to hadith.

🪴🍃This demonstrates their profound respect for the scholars and their recognition for their valuable contributions. Today however, as soon as students poorly memorise the forty ahadith of al Nawawi they say: "I don't have to follow them, I can have my own opinion on this matter."

They want to establish themselves as independent scholars, having their own schools and choices. Indeed, it is a grave mistake for a student of knowledge to be raised upon such an approach.
