Dear Level 4 students,

Law Society team gathered some useful tips for your upcoming Tort Law and Public Law final assessments.

1 PRACTICE IRAC

๐Ÿ”น Issue, Rule, Application/Analysis, Conclusion. The IRAC method never gets old in the legal sphere. One of the best skills that will be useful during the exam is the proper ability to apply the IRAC to the given case scenarios. Identifying the relevant issue, searching for the suitable rule, applying the rule to the exact given case scenario, and drawing a proper conclusion is not easy to do for the first time. Therefore, when resolving a certain case, try to practice IRAC more and keep tracking your progress.
Practice makes perfect!

2 CASES AND LEGISLATION

๐Ÿ”น Reading and proper preparation are the keys to increasing chances of getting a better mark. Try to write down and categorize different cases with different topics so it would be easier to learn them in advance. If the exam will be based on certain legislation, get familiar with it so it will not take too much time during the exam to revise it.

๐Ÿ”น One of the suggested ways that can be used when learning cases is associating the case with a certain word or subject matter. For example, Donoghue v. Stevenson: snail in the bottle, duty of care. Try to provide each case with a simple association, which will easily remind you of the facts and the principle established within the case itself. This way, learning cases will be more efficient and easy.

๐Ÿ”น In addition, it would be useful if more focus were given to the judgment of the case rather than its facts. It might be tempting to get more familiar with the facts of a case since they are quite interesting; however, while facts are important, it would be better to also focus on the judgment and the reasoning behind it. The legal reasoning used by the judges when resolving the case is what makes a case applicable to other situations. Therefore, do not forget to pay attention not only to what happened but also to the outcome of the case.

Dear Level 4 Commercial Law students,

๐ŸšจThe deadline for your first Tort Law CW is approaching! We had gathered some guidelines that could help your successful submission.

1. IDENTIFY THE TOPIC

๐Ÿ”นBefore writing any type of coursework, you should understand what you are writing about. That's why take some time to read the assessment task and think of what lecturers want from your legal writing. Afterward, try to identify to which topic your essay belongs. This would make your research much easier. If you do not know where to start, try reading task description it might help to guide you through your coursework!

2 READ MORE!

๐Ÿ”น Yes, this is inevitable. In order to write, you need to have some knowledge, and this knowledge is usually derived from books or scholarly articles. When you have identified to which topic your essay belongs, it is a perfect time to start reading! If you found any information that you believe is relevant or useful to your topic, write it down in a separate document to put into your essay later.

๐Ÿ”น Do not use any AI tools to write your coursework. Turnitin is able to identify the percentage of AI usage in your essay, which will lead to a failure of the module.

3 STRUCURE YOUR ESSAY

๐Ÿ”น Now when you gathered looooots of different information, structure it!
For example, divide your topic into subtopics:

Negligence
- duty of care
- breach
- causation


Identify internal elements of your topic and write each one as long as they are relevant to your task. You could also read some scholarly articles and compare their structure with yours. However, remember that you should track word limit and not go beyond it!

4 CASES ARE EVERYWHERE..

๐Ÿ”น Try to provide cases for each principle you describe in your coursework. Cases are important to prove your point and make your essay more detailed. However, remember to use relevant cases and focus mostly not on the descriptive part but on the judgment of the court and the rationale behind it. Analyze of the case will bring much more useful information in comparison with simple description of the facts. For example: One of the primary cases that established Duty of care principle is Donoghue v Stevenson, where the court articulated the principle of the "neighbour testโ€ to manufacturers, suggesting that they must take reasonable care to avoid acts or omissions that could foreseeably harm others.

๐Ÿ”น In addition, do not forget to use OSCOLA referencing style and insert footnotes for each case, book, or article that you use in your writing!
