Judiciary Mains Exam Problem Based Question -
The accused in a murder case is granted bail by the Sessions Court after 42 days of judicial custody. The State approaches the High Court under Section 439 (2) read with Section 482 Cr.P.C for cancellation of the bail. In the meanwhile, in a writ petition, the High Court orders that the investigation of the case shall be taken over by the CBI. The CBI registers a fresh FIR against the accused after 35 days of his obtaining bail. The order of bail granted by the Sessions Court is set aside by the High Court (after 40 days of granting bail) for the reason that the accused was granted bail too early. The accused is re-arrested after 42 days of his obtaining bail and is remanded to judicial custody. The CBI then obtains police custody of the accused for 3 days. After further remanded custody for 48 days the accused files an application before the Sessions Court for default bail contending that no “police report” has been filed after 90 days of his remand. His application is opposed by the Public Prosecutor contending inter alia that the period has to be reckoned from the date of the custody of the accused after the CBI registered the FIR and not from the date of the first remand and that the accused is not entitled to tack on the two broken periods of custody for the purpose of default bail. Is the accused entitled to default bail?

I hope this letter finds you in good health and spirits, despite the challenging circumstances we have faced in our journey together. Today, I write to you not only as a educator but as someone deeply moved by the strength, unity, and courage each of you has shown in standing up for justice in the face of adversity.

We embarked on a difficult battle, raising our voices against the irregularities we believed existed in the RJS Mains copy-checking process. Our fight was never just about a personal outcome; it was about upholding the principles of fairness, transparency, and integrity that form the backbone of the judiciary we all aspire to serve.

While the Honorable Supreme Court has dismissed our writ petition, stating that no prima facie irregularities were found in the evaluation process, I want to take a moment to reflect on what we have achieved as a collective. The outcome of the court's decision may not be in our favor, but that does not take away from the courage it took to stand up and challenge a system, to raise concerns and demand accountability.

The legal battle may have come to a close, but the bond we have formed, and the spirit of solidarity we have shared, will remain stronger than any verdict. We fought with dignity, perseverance, and hope, and these qualities will continue to serve us in our future endeavors.

To each one of you who stood up, spoke out, or silently supported the cause — thank you. Your determination and commitment to justice reflect the very values that we, as future judicial officers, will be expected to protect. Though the legal fight may have ended, the lessons we've learned and the unity we have displayed will guide us in the years to come.

Let this experience not discourage us but inspire us to work harder, to be the change we seek within the system. The judiciary needs passionate, driven individuals like you who are willing to stand for what is right, even when the odds seem stacked against them.

I am proud to have fought alongside each and every one of you, and I am confident that this is not the end but a new beginning for us all.
