निर्वाचन का सिद्धांत

निर्वाचन का सीधा सा अर्थ है चयन करना, विधिक शब्दावली में निर्वाचन का सिद्धांत समानता के सिद्धांत पर आधारित है, जिसमें न्यायालय द्वारा एक पक्षकार पर दो असंगत अधिकारों को चयन करने का दायित्व है अपितु उसे दोनों का उपभोग नहीं करना चाहिये।

यह सिद्धांत संपत्ति अंतरण अधिनियम, 1882 की धारा 35 के तहत आता है।

धारा 35 के तहत सिद्धांत - अंतरक उस संपत्ति को अंतरित करने का दावा करता है, जो उसकी स्वयं की नहीं है।

उसी संव्यवहार में, संपत्ति के मालिक को लाभ प्रदान किया जाता है।

मालिक को या तो अंतरण की पुष्टि करनी होगी या उस पर असहमति व्यक्त करनी होगी।

यदि वह असहमत है, तो वह इस प्रकार प्रदत्त लाभ को त्याग देगा।

इस प्रकार त्यागा गया लाभ अंतरक या उसके प्रतिनिधि को वापस लौटा दिया जाता है, जहाँ:

अंतरण नि:शुल्क होता है या निर्वाचन से पहले अंतरक की मृत्यु हो जाती है या वह नवीन अंतरण करने में असमर्थ हो।

अंतरण विचारणीय हो।

फिर, निराश अंतरिती को हस्तांतरित की जाने वाली संपत्ति की राशि के बराबर क्षतिपूर्ति देना होगा।

निराश अंतरिती:

एक अंतरिती जो दिये गए लाभों को अस्वीकार करने का विकल्प चुनता है, संव्यवहार से असहमत होता है और अब संपत्ति नहीं ले सकता है वह एक निराश अंतरिती है।

निर्वाचन का विकल्प:

जो व्यक्ति प्रत्यक्ष लाभ का हकदार नहीं है, लेकिन संव्यवहार के तहत अप्रत्यक्ष लाभ का हकदार है, उसे चुनाव करने की आवश्यकता नहीं है।

सिद्धांत का अपवाद:

जहाँ उस संपत्ति के मालिक को एक विशेष लाभ प्रदान किया जाना व्यक्त किया जाता है, जिसे अंतरक अंतरित करने का दावा करता है, और ऐसा लाभ उस संपत्ति के बदले में होने के लिये व्यक्त किया जाता है, यदि ऐसा मालिक संपत्ति का दावा करता है, तो उसे विशेष लाभ त्यागना होगा, लेकिन वह उसी संव्यवहार से प्राप्त किसी अन्य लाभ को छोड़ने के लिये बाध्य नहीं है।

चुनाव के प्रकार:

जिस व्यक्ति को लाभ प्रदान किया गया है, उसके द्वारा लाभ स्वीकार करना चुनाव कहलाता है, यदि:

वह चुनाव के लिये अपने कर्त्तव्य के प्रति जागरूक हो।

वह उन परिस्थितियों से अवगत हो, जो चुनाव करते समय किसी उचित व्यक्ति के निर्णय को प्रभावित कर सकती हैं, या

वह परिस्थितियों की जाँच से इनकार करता हैं।

ऐसे मामले में जहाँ मालिक ने उपर्युक्त प्रावधानों का अनुपालन करने के पश्चात् जानबूझकर लाभ स्वीकार कर लिया है, यह दर्शाता है कि उसने संव्यवहार स्वीकार कर लिया है। एक अनुमान को स्वीकृति की ओर लाया जाता है, जहाँ:

असहमति व्यक्त करने का कोई कार्य किये बिना वह दो वर्ष तक लाभ उठाता है।

वह कुछ ऐसे कार्य करता है, जिसके द्वारा पक्षकारों को उनकी मूल स्थिति में बहाल करना असंभव है।

सीमा अवधि:

जहाँ अंतरण की तिथि के बाद एक वर्ष के भीतर मालिक अंतरक या उसके प्रतिनिधियों को अंतरण की पुष्टि करने या उससे असहमति जताने के अपने आशय के बारे में सूचित नहीं करता है, अंतरक या उसके प्रतिनिधि को उस अवधि की समाप्ति पर उसे निर्वाचन करने की आवश्यकता हो सकती है।

यदि वह ऐसी मांग प्राप्त होने के बाद उचित समय के भीतर उसका अनुपालन नहीं करता है, तो उसे अंतरण की पुष्टि करने के लिये चयनित माना जाएगा।

अंतर-अभिवचनीय वाद (Interpleader Suit) एक प्रकार का वाद है, जो तब दायर किया जाता है जब एक व्यक्ति (जिसे "इंटरप्लीडर" कहा जाता है) किसी संपत्ति या धन के बारे में कई व्यक्तियों से दावे प्राप्त करता है, और वह यह नहीं जानता कि असली हकदार कौन है। इस स्थिति में, वह व्यक्ति न्यायालय से यह निर्णय प्राप्त करने के लिए मुकदमा दायर करता है कि उस संपत्ति या धन का वास्तविक हकदार कौन है।

यह वाद मुख्य रूप से तब दायर किया जाता है जब एक व्यक्ति को दो या दो से अधिक लोगों द्वारा एक ही संपत्ति पर दावा किया जाता है, और वह व्यक्ति (जो इंटरप्लीडर होता है) खुद उस संपत्ति का हकदार नहीं है, बल्कि केवल उस संपत्ति को या धन को रखने वाला है।

उदाहरण:

मान लीजिए कि एक व्यक्ति के पास किसी बैंक में जमा राशि है और उसकी मृत्यु हो जाती है। अब दो लोग दावा करते हैं कि वे मृतक के कानूनी उत्तराधिकारी हैं और उन्हें वह राशि मिलनी चाहिए। ऐसे में, बैंक इस संपत्ति (धन) के बारे में निर्णय लेने के लिए एक अंतर-अभिवचनीय वाद दायर कर सकता है, ताकि न्यायालय यह तय कर सके कि वह राशि किसे दी जाए।

प्रावधान: धारा 88 और आदेश 35

सिविल प्रक्रिया संहिता 1908 के तहत धारा 88 के अनुसार, अंतर-अभिवचनीय वाद दायर किया जा सकता है। इसमें, एक व्यक्ति (इंटरप्लीडर) संपत्ति या धन को न्यायालय में जमा कर सकता है और न्यायालय से यह निर्णय प्राप्त करने के लिए कह सकता है कि उसे किसे सौंपना चाहिए। अंतर-अभिवचनीय वाद की प्रक्रिया सिविल प्रक्रिया संहिता, 1908 के आदेश 35, नियम 1 से 4 द्वारा शासित होती है।

अंतर-अभिवचनीय वाद के आवश्यक तत्व

सिविल प्रक्रिया संहिता 1908 में अंतर-अभिवचनीय वाद दायर करने से पहले, धारा 88 के अनुसार निम्नलिखित शर्तों को पूरा करना आवश्यक है:

1. विवादित ऋण या संपत्ति: इस वाद में कोई विवादित ऋण, धनराशि, या अन्य संपत्ति, चाहे वह चल संपत्ति हो या अचल संपत्ति, होनी चाहिए।

2.कई दावा करने वाले: इस ऋण, धनराशि, या संपत्ति पर दो या दो से अधिक व्यक्तियों द्वारा विरोधी दावे किए जाने चाहिए।

3.निरपेक्ष दावा करने वाला: जिस व्यक्ति से ऋण, धनराशि, या संपत्ति का दावा किया जा रहा है, उसे इसमें कोई स्वार्थ नहीं होना चाहिए, सिवाय शुल्क और लागत के। उसे यह संपत्ति सही हकदार को देने या भुगतान करने के लिए तैयार और इच्छुक होना चाहिए।

4.कोई लंबित मुकदमा नहीं: ऐसा कोई अन्य मुकदमा नहीं होना चाहिए, जिसमें प्रतिद्वंद्वी दावेदारों के अधिकारों का सही तरीके से निर्णय लिया जा सके।
