For this reason, we strongly recommend our learners to build a startup focused practice (doing contracts, IP, compliances, etc) as a precursor to litigation.

Even if you do not have any skills right now, you can quickly develop them in a matter of a few months, and accelerate your client development and earnings.

So, this work helps you in building relationships and trust with future litigation clients, and also taking care of your financial needs while you are working on your litigation career so that it can take off.

Imagine getting litigation work from them, a few years down the line, because you nurtured them in your initial years.

But your competition will not be able to do that.

The good news is that many of these startups are expanding internationally to sell their products and services to foreign markets, so you could even get exposure to international arbitration matters if there is a dispute in an international contract!

If you have been the lawyer who assisted such clients with such services and you did a good job, guess whom will they appoint for the dispute?

You will be their first point of contact.

You could get international commercial arbitration mandates when the contracts of these startups go into dispute a few years down the line!

It is not just for arbitration - whom will they approach for employment, money recovery, IP or other disputes? If you do this well, you could get a lot of disputes-related mandates.

If you expect to do that right at the beginning, you are missing an important step.

The problem with high stakes litigation is that clients do not want to trust unknown lawyers they have never worked with or never heard of.

It is far easier to get other work from them, such as legal notices, employee disputes, money recovery, or small problems with authorities, etc.

This is where you can build your initial traction.

Imagine that you work with many startups and SMEs and help them include arbitration clauses in some of these contracts. In a few years, there will be disputes over some of these contracts.

At that time, getting work from your existing clients to take care of those disputes will be far easier, as there is an existing relationship and trust between the client and you.

For example, you can put a cap like review only up to 10 contracts from a disputes perspective to ensure that dispute resolution clauses are watertight, insert functional & cost-effective arbitration clauses, and do up to 2-3 legal notices or reply to notices.

If there is a dispute, you can charge an additional amount as that will not fall in the scope of your retainership.

You can also use AI to respond send or respond to legal notices to win their trust - most traditional lawyers will not want to do this work, but you will have an advantage.

Is this going to distract you from my litigation goals? Not at all.

If you want to set up a corporate litigation and arbitration practice as a young lawyer, it is not necessary that you can do so only by appearing in matters before court.

A good lawyer in the market costs upwards of INR 80,000.

This is the fresher salary in a good law firm, and most of these freshers cannot deliver results independently and work under partner supervision.

When they are on such a fast growth trajectory, there is too much at stake, for example:

🔺 Investors want legal compliances and contracts to be in place,

🔺 Non-enforcement of contracts with one party can trigger defaults across the board because it sends the wrong signals to everyone else.

🔺 If one employee leaves with confidential data and joins a competitor, others can easily do that too.

🔺 There can be reputational consequences if, for example, the company does not have proper systems and governance. Legal help is much needed here.

This is why if you can deliver the results at INR 20K/month for an early stage startup or smaller business, you will be super competitive.

You can limit the work you will do every month for your retainer.

Today, this is not expensive for early stage startup entrepreneurs who are serious about growth.

Imagine that you have such retainers with 5 startups. How much can you earn every month?

INR 1 lakh.

It is very much realistic to get such retainers.

Some of you may have this question: ‘Why will startups or SMEs pay a new entrant?’

Consider what alternative the startup has. If they go to a law firm, their bills will be unmanageable and run into several lakhs. If they want to hire a lawyer full time, then let us understand the cost.

You might think that they can hire a fresher at 25-30K/month salary - but such a person cannot deliver any results at all. Who will supervise the fresher?

The Indian startup ecosystem is the 3rd largest in the world and is growing very rapidly, with startups having access to enormous venture capital and private equity.

Many are planning international expansion, following the growth of successful Indian startups like Zoho, FreshWorks, ChargeBee, etc.

Successful Indian startups are the new MNCs of tomorrow.

Imagine that you have obtained retainers of INR 20,000 per month, for handling various kinds of disputes and money recovery matters, drafting contracts, giving legal advice, sending notices, responding to notices from regulatory authorities, etc, where you put in approximately 10-20 hours of work.

If you can tap this market as a litigator, you will grow in your legal career and make 5x more money than what you would working with individual clients.

You don’t have to be a corporate lawyer or a lawyer employed with a company as an in-house counsel to be a corporate litigator.

You can very much be an independent litigator and have corporate clients.
