‎Question: Does an absolute truce with the Enemy (of the Muslims) imply acknowledging what it has occupied of the Muslim lands in Palestine, and that it has forever become a right for the Jews, established through treaties endorsed by the United Nations, which represents all the nations of the world and empowers it to penalize any country that seeks to recover this land or fight the Jews in it?

‎Shaykh Abd Al-Aziz Bin Baz رحمه الله: “A الصلح (Peace treaty/truce) [1] with the Ruler of the Muslims in Palestine and the Jews does not necessitate granting the Jews permanent ownership of what they have under their control/hands, but rather it requires granting them temporary ownership until the temporary truce ends or until the Muslims become strong enough to expel them from the lands of the Muslims by force during the absolute truce.

‎Thus, they should be fought when (the Muslims have the) capability until they either enter into Islam or pay the jizyah and feel themselves subdued. Similarly, this applies similarly to Christians and Majoos, as stated by Allah in Surah At-Tawbah 29, ‘Fight against those who (1) believe not in Allah, (2) nor in the Last Day, (3) nor forbid that which has been forbidden by Allah and His Messenger (4) and those who acknowledge not the religion of truth (i.e. Islam) among the people of the Scripture (Jews and Christians), until they pay the Jizyah with willing submission, and feel themselves subdued.’

‎It has been established in the authentic (Ahādith) that (the Messenger) ﷺ would take the Jizyah from the Majoos. Due to that they are given the same ruling as Ahl Al-Kitab in (the matter) of taking the Jizyah only, that’s if they do not accept Islam. However, the permissibility of their food and women for the Muslims, it is exclusive to Ahl Al-Kitab, as established in Allah’s Book in Surah Al-Ma’idah. Furthermore, Al-Hafidh Ibn Kathir رحمه الله explicitly mentioned in his tafsir of Allah’s saying in Surah Al-Anfal 61, ‘But if they incline to peace, you also incline to it,’ The Ayah, in the context of what we mentioned regarding reconciliation.”
