የሰበር ሰሚ ችሎት ጥቅምት 6 ቀን 2017 ዓ.ም በዋለው ችሎት የወራሽነት የምስክር ወረቀት የያዘ ሰው በማንኛውም ጊዜ የውርስ ንብረት ጥያቄ ማንሳት ይችላል ተብሎ ከዚህ ቀደም በሰበር በመ/ቁ 205248፣ መ/ቁ 44237፣ 38533 የተሰጡ ውሳኔዎችን አሻሽሏል። በሌላ ልዩ ሕግ የተደነገገው እንደተጠበቀ ሆኖ የወራሽነት ጥያቄ በፍ/ሕ/ቁ 1000 በተመለከተው የጊዜ ገደብ በይርጋ ይታገዳል። የውርስ ማጣራት ተጠናቆ ንብረቱ የጋራ ባልሆነበት ሁኔታ የወራሽነት ምስክር ወረቀት በመያዝ ብቻ የፍ/ሕ/ቁ 1062 መሠረት በማድረግ ያለጊዜ ገደብ የክፍፍል ጥያቄ ሊነሳ አይችለም የሚል የሕግ ትርጉም ተሰጥቷል።

የጽሑፉ ዓላማ በሰበር ችሎት የውርስ ሕግ አተረጓጎም ላይ ያለውን ችግር እና የመፍትሄ ሃሳቦች በማሳየት ወደ ፊት የሰበር የሕግ ትርጉሞች ተለውጠው ችግሮቹ ተፈትው የውርስ ክርክሮች ሕጉን መሠረት አድርገው ወጥ፣ ተገማች እና ተመሳሳይ መፍተሄ እንዲያገኙ አስተዋጽዖ ለማድረግ መሆኑን ያሳስባሉ።

በ፦ሙሉቀን ሰይድ ሐሰን (የሕግ አማካሪና ጠበቃ)

የአሰሪና ሰራተኛ ጉዳይ አዋጅ ቁጥር 1156/2011 አንቀጽ 27 ስር ያለ ማስጠንቀቂያ የስራ ውል የሚቋረጥባቸው ሁኔታዎች ተጠቅሰዋል፡፡ በዚህም ጽሁፍ በአንቀጽ 27 ስር ከተመለከተቱት ዝርዝር ሁኔታዎች የተወሰኑት በመጥቀስ የፌዴራል ጠቅላይ ፍርድ ሰበር ሰሚ ችሎት ውሳኔዎች ጋር በማገናዘብ አጭር ዳሰሳ ለማደረግ ተሞክሯል፡፡

በዚህ ጽሑፍ፦

1) የሥራ ሰዓት አለማክበር
2) ከሥራ ገበታ መቅረት
3) በስራው ላይ የማታለል ተግባር መፈጸም፡፡
4) ከአቅም በታች መስራት፡፡

The concept of incitement is not defined in international instruments. Etymologically the word ‘incite’ derives from the Latin verb incitare, meaning ‘to set in rapid motion, rouse, stimulate. L.W. Sumner expresses incitement as ‘the idea of galvanizing someone into action by appealing to the passions rather than to reason’: Inciting to action thus contrasts with counseling, or advising, or persuading. It works by getting the subject worked up or agitated rather than by offering a convincing argument.
