Al-Ṭabarisī notes, however, that some claimed that Jesus’ intellect was perfected and he was a prophet from this time onward, in which case his miraculous ability to speak as an infant continued beyond this encounter with his mother’s family.

ميراث حديث شيعه: عصر امامان باقر و صادق (ع)، دکتر حسن انصاری

جلسات یازدهم و دوازدهم: در اين دو جلسه آخر درباره اين موضوعات بحث شد: ۱) تاريخچه فقه حنفی در دوره تأسيس آن و بحثی درباره ادبيات فقهی آنان و مقايسه با ادبيات فقهی متقدم اماميه؛ ۲) تاريخچه فقه متقدم شافعی و شرحی درباره سهم شافعی در تثبيت "سنت" و همچنين درباره کتاب های او و مقايسه اين کتاب ها با ادبیات فقه مذاهب ديگر و از جمله فقه اماميه؛ ۳) مراحل تثبيت مذاهب فقهی چه بود؟ و بحثی درباره نحوه تثبيت فقه مذاهب اربعه تا سده هفتم قمری؛ ۴) تکميل بحث اصحاب اجماع در اماميه. در اين جلسه تحليل تازه ای درباره زمينه های شکلگيری مفهوم اصحاب اجماع در ارتباط با موضوع واقفه و غيبت امام دوازدهم (عج) مطرح کرديم؛ ۵) تحليلی نو درباره علل روايت های متعدد کتاب های حديثی و توضيح درباره تعبير: " له کتاب رواه جماعة". ميراث حديث شيعه: عصر امامان باقر و صادق (ع)، دکتر حسن انصاری

جلسه نهم: در اين جلسه درباره روند تدريجی و شرایط تاريخی تثبيت مذاهب فقهی در اسلام پرداختيم و مراحل مختلف آن را به بحث گذاشتيم. سهم قدرت سياسی از يک سو و همچنين مراحل مختلف مرجعيت دينی مکاتب فقهی را از دیگر سو از نقطه نظر تحول ادبی بحث کرديم. در اين راستا به مراحل تدوين کتاب های حديثی و فقهی اماميه از دوران امام صادق (ع) به بعد پرداختيم؛ از مرحله اصول اوليه تا کتاب های مصنّف تا کتب جامع و همچنين تدوين "مختصر" های فقهی و کتاب های شرائع. به سهم کوفه، قم و بغداد پرداختيم و نقش اصحاب اجماع در تثبيت حديث و فقه امامی. جلسه هفتم: در این جلسه از این موضوعات بحث شد: ۱) نزاع دو سنت شفاهی و کتبی در تدوین حدیث و فقه در اسلام. ۲) قدرت فقهی چگونه به عنوان قدرتی مدنی در برابر نهاد قدرت سیاسی در اسلام شکل گرفت و تأثيرش در روند تدوین فقه و حدیث چه بود؟ ۳) بحث حجیت در سده دوم در چه بافتار سیاسی و دینی شکل گرفت و مقایسه ای میان نظریه امامیه در این زمینه و اهل سنت. ۴) بحث از فقه واقفه و مقايسه آن با فقه اماميه قطعيه. ۵) اصحاب اجماع در اماميه و مرجعيت فقهی آنان. ۶) دنباله بحث از انواع ادبی تدوین حدیث و فقه در مذهب مالکی و مقایسه آن با مکتب امامی. 🔸در طی این شش درسگفتار درباره مشابهت ها و تمایزها میان دو سنت حدیث و فقه میان دو مکتب اهل مدینه/ اهل رأی کوفه از یک سو و مکتب دو امام باقر و صادق (ع) صحبت شد و با بررسی نمونه های اولیه ادبیات فقه و حدیث مالکی تلاش شد نمونه های مشابه را در مکتب فقه جعفری مورد بررسی قرار دهیم. در جلسه هفتم این بحث دنبال خواهد شد.

Many books have been written on the topic of whether Islam is compatible with democracy. These works have focused on both theological aspects and the emergence of so-called “Islamist parties”. This lecture examines and interrogates this discourse, all while arguing that the very question is rooted in prejudice and Islamophobia.

جلسه پنجم: در اين جلسه برای نخستين بار درباره مشابهت های دو سنت اوليه کتابت حديث و فقه ميان دو مکتب شيعی (امام باقر و امام صادق عليهما السلام) و مکتب مدينه (اهل حديث مدينه/ مالکی) بحث کرديم. از موطأ و مدونه و اسمعه و اصول بحث کرديم و شباهت این ادبیات را با ادبیات مشابه در سنت/ سنت های شیعی مورد توجه قرار داديم. همچنين درباره شيوه منبع يابی در کتاب کافي کلينی بحث کرديم. و اشاره کردیم به دو نسخه رازی و بغدادی کتاب الکافی. در بخشی از جلسه هم درباره "طباق السماع" ها در سنت نسخه های خطی بحث کردیم. جلسه چهارم: در اين جلسه در دنباله مباحث جلسه قبل کوشيديم با بررسی محيط فقهی مدينه در سده دوم و به طور خاص مکتب مالک بن انس و فقه مالکی و شيوه های تدوين حديث و فقهش راهی برای درک شباهتها و تمايزها با مکتب دو امام باقر و صادق (ع) در مدينه همان دوران پيدا کنيم. از موطأ مالک گفتيم و از مدونه در فقه مالکی و همچنين شيوه های مالک در روایت حدیث و فقه. به نظر ما برای درک شیوه های آموزش و نقل و کتابت حديث و فقه در ميان شيعه در اين دوران بايد شيوه های مکاتب مشابه در مدينه و کوفه را بررسی کرد. جلسه سوم: در اين جلسه به اين موضوعات پرداخته شد: ۱) نحوه تأليف کتاب در دو سه قرن اول اسلامی چگونه بود؛ به ويژه در زمانی که هنوز صنعت کاغذ در دنيای اسلام گسترده نشده بود؟ ۲) آيا ائمه شيعه خود کتابی نوشته اند؟ ۳) آيا پيشوايان حديث و فقه اهل سنت در دو سه قرن اول خود کتاب هايشان را می نوشتند يا اينکه آثار منسوب به آنان مانند "اصول" حديث اصحاب ائمه شيعه حاصل مجالس درس و حديث و فقه آنان بوده است؟ ۴) اشکال و انواع مختلف تأليف کتاب در دو سه قرن اول اسلامی چگونه بود؟ ۵) مجالس سماع و قرائت و مقابله نسخه ها با استادان در قرون اوليه اسلامی به چه صورت هایی بود؟ ۶) بحث از سماع و قرائت و عرض و انهاء و اجازه و تعليق و اصل و امالی و ...۷) چرا در دو سه قرن اول اسلامی برخی از محدثان در اواخر عمر خود آثار و اصول حديثی خود را یا با آب می شستند و يا می سوزاندند و از بین می بردند تا مورد تحريف و دسّ و تدليس بدخواهان بعد از مرگشان قرار نگيرد؟ ۸) راه های جلوگيری از تحريف و جعل و تصحيف در نسخه های حديثی چه بود در زمانی که هنوز صنعت چاپ وجود نداشت؟ ۹) منابع کتاب های حديثی شيعی مانند الکافي چيست؟ ۱۰) چرا ائمه شيعه برای شيعيان رساله های عمليه ننوشته اند؟

در پايان اين جلسه مقداری هم در نقد گفتاری از آقای دکتر عباس امانت درباره تشيع عصر صفوی صحبت کرديم. همچنين از نقش علامه مجلسی در اين دوران سخن گفتیم. به مناسبت اين بحث از تلاش های استادان شادروان محمد تقی دانش پژوه و زنده یاد احمد منزوی و همچنین استاد رسول جعفريان و نیز انتشارات ميراث مکتوب و دکتر اکبر ايرانی هم صحبت به ميان آمد.

در اين دو جلسه درباره زمينه تاريخی مکتب امامان باقر و صادق (ع) در مقايسه با مکاتب فقهی ديگر همعصر با آن دو امام بحث کرديم و گفتيم که برای شناخت جايگاه اين دو امام در بافت کلی اسلام در سده دوم قمری و به ويژه تاريخ تحول و شکلگيری فقه اسلامی بايد نخست بدانيم که فقه اسلامی چطور در امصار و بوم های مختلف در سده دوم قمری شکل گرفت، به ويژه در مدينه و کوفه و با توجه به دو فقه اهل حديث و اهل رأی. همچنين از نقش شافعی در اواخر سده دوم قمری بحث کرديم. همچنين به نحوه تدوين مجموعه های حديث شيعی و اهل سنت پرداختيم و اينکه معنای حديث در مکتب تشيع با معنای حديث در اهل سنت فرق می کند. تمايزهای اساسی دو مکتب فقهی را بحث کرديم و گفتيم که فقه امامان شيعه به ويژه در واکنش به نظام سازی فقه اهل رأی به تدريج تدوين شد.
