📌 Когда НДФЛ при продаже недвижимости НЕТ.

Семья с двумя и более несовершеннолетними детьми может НЕ платить налог с продажи жилья вне зависимости от срока владения им,

НО есть условия (выполнить их нужно все):

☑️ на дату продажи налогоплательщик имеет не менее 2-х детей (в том числе усыновленных), не достигших возраста 18 лет (24 лет, если дети учатся очно) или собственником является такой ребенок;
☑️ в календарном году, когда прошла продажа, или не позднее 30 апреля следующего календарного года налогоплательщиком приобретено (полная оплата по ДДУ или регистрация права собственности) иное жилое помещение (доля);
☑️ кадастровая стоимость проданного жилого помещения не более 50 млн рублей;
☑️ общая площадь нового жилья превышает общую площадь в проданном жилом помещении или его кадастровую стоимость;
☑️ налогоплательщику, его супругу (супруге) и его детям в возрасте до 18 лет на дату продажи не принадлежит в совокупности более 50% в праве собственности на другое жилье с общей площадью или кадастровой стоимостью, превышающими общую площадь в приобретенном жилье.

Важно: Льготу нужно заявить, т.е. в любом случае заполнить налоговую декларацию, приложив подтверждающие документы.

Основание - п. 2.1. ст. 217.1 НК РФ

Напомним, изменения были приняты в ноябре 2021 года и их распространили в т.ч. на доходы с продажи жилья, полученные в 2021 году.
