♟️Among all the committees of the Constituent Assembly, the most important committee was the Drafting Committee set up on August 29, 1947.

♟️This consisted of seven members. They were:

♟️Dr. B.R. Ambedkar (Chairman)

♟️N. Gopalaswamy Ayyangar

♟️Alladi Krishnaswamy Ayyar

♟️Dr. K.M. Munshi

♟️Syed Mohammad Saadullah

♟️The first hour of every parliamentary sitting is slotted for this.

♟️During this time, the members ask questions and the ministers usually give answers. The questions are of three kinds, namely, starred, unstarred and short notice.

♟️A starred question (distinguished by an asterisk) requires an oral answer and hence supplementary questions can follow.

♟️An unstarred question, on the other hand, requires a written answer and hence, supplementary questions cannot follow.

♟️A short notice question is one that is asked by giving a notice of less than ten days. It is answered orally.

*🛡️Adjournment*

♟️A session of Parliament consists of many meetings. Each meeting of a day consists of two sittings, that is, a morning sitting from 11 am to 1 pm and post-lunch sitting from 2 pm to 6 pm.

♟️A sitting of Parliament can be terminated by adjournment or adjournment sine die or prorogation or dissolution (in the case of the Lok Sabha).

♟️An adjournment suspends the work in a sitting for a specified time, which may be hours, days or weeks.

*🛡️Joint Parliamentary Committee (JPC)*

♟️Type- Ad-hoc Committee of the Indian Parliament.

♟️Purpose- To investigate specific subjects or Bills, often related to allegations of misconduct or national importance.

♟️Composition-
Members: Drawn from both Houses (Lok Sabha and Rajya Sabha) and include both ruling and opposition parties.
Chairperson: Appointed by the Speaker of the Lok Sabha.
Term: Dissolves after completing its assigned task.

♟️Functions-
Investigation: Collects evidence from experts, public bodies, and other stakeholders.
Recommendations: Advisory in nature.

♟️From 1950 to 1973, the practice has been to appoint the seniormost judge of the Supreme Court as the chief justice of India.

♟️This established convention was violated in 1973 when A.N. Ray was appointed as the Chief Justice of India by superseding three senior judges.

♟️Again in 1977, M.U. Beg was appointed as the chief justice of India by superseding the then senior-most judge.

♟️This discretion of the government was curtailed by the Supreme Court in the Second Judges Case (1993), in which the Supreme Court ruled that the seniormost judge of the Supreme Court should alone be appointed to the office of the chief justice of India.

*🛡️Dissolution*

♟️Rajya Sabha, being a permanent House, is not subject to dissolution. Only the Lok Sabha is subject to dissolution.

♟️Unlike a prorogation, a dissolution ends the very life of the existing House, and a new House is constituted after general elections are held.

♟️The dissolution of the Lok Sabha may take place in either of two ways:

1. Automatic dissolution, that is, on the expiry of its tenure of five years or the terms as extended during a national emergency; or

2. Whenever the President decides to dissolve the House, which he is authorised to do. Once the Lok Sabha is dissolved before the completion of its normal tenure, the dissolution is irrevocable.

*🛡️Language In Parliament*

♟️The Constitution has declared Hindi and English to be the languages for transacting business in the Parliament. However, the presiding officer can permit a member to address the House in his mother-tongue. In both the Houses, arrangements are made for simultaneous translation.

♟️Though English was to be discontinued as a floor language after the expiration of fifteen years from the commencement of the Constitution (that is, in 1965), the Official Languages Act (1963) allowed English to be continued along with Hindi.

*♟️Qualification Of Judges*

♟️A person to be appointed as a judge of the Supreme Court should have the following qualifications:-

✔️He should be a citizen of India.

✔️a) He should have been a judge of a High Court (or high courts in succession) for five years; or (b) He should have been an advocate of a High Court (or High Courts in succession) for ten years; or (c) He should be a distinguished jurist in the opinion of the president.

♟️From the above, it is clear that the Constitution has not prescribed a minimum age for appointment as a judge of the Supreme Court.

♟️It defines the term ‘state’ for the purposes of Part III.
♟️ *Article 12 and applicability on United Nation (UN)* The Delhi High Court has ruled earlier that the UN is not a State under Article 12 and hence cannot be brought under the jurisdiction.
♟️ *Article 12 and PM CARES fund* The Centre recently informed the Delhi High Court in a plea seeking to declare the fund a ‘state’ under Article 12 that:
♟️PM CARES Fund is set up as a public charitable trust and is not created under the Constitution or any law made by the Parliament or the state.

💎 *Judiciary under Article 12*

♟️ *Judicial & Non-Judicial Function* When the Judiciary is discharging Judicial functions, it is not regarded as a State whereas the non-judicial function brings it under the definition of ‘State’.

*💎Related Cases*

♟️ *Naresh Shridhar Mirajkar case (1966)* Judiciary should be put under the ambit of Article 12, otherwise the courts would be allowed to make rules which violate the fundamental rights of the citizens.
♟️ *Rupa Ashok Hurra v. Ashok Hurra case (2002)* Superior courts of justice do not fall within the ambit of ‘state’ or ‘other authorities’ under Article 12.
♟️ *Riju Prasad Sarmah Case (2015)* The court again held that when a court is acting in its judicial capacity, it cannot be regarded as a State. However, its administrative action is amenable to the writ jurisdiction.

*🛡️Council of Ministers in states*

♟️In a Parliamentary form of government, the council of ministers headed by the Chief Minister is the executive authority.

♟️The states under the Indian constitution are organised on the pattern as that of
the centre.

♟️The Council of Ministers in the state is a replica of the council of Ministers at the centre.

♟️They resemble in formation, function and role in the administration.

♟️The constitution provides a broad and general view of the principles of Parliamentary system of Government in Article 163 and Article 164 .

♟️Council of ministers are there to aid and advise the Governor of the state in
various matters.

*🛡️Public Accounts Committee(PAC)*

♟️It is a financial parliamentary committee.
♟️It was set up first in 1921 under Government of India act 1919.
♟️It consists of 22 members (15-Lok Sabha , 7- Rajya Sabha). A minister cannot be its member.
♟️The term of office of the members is one year. The members are elected by the Parliament every  year from amongst its members.
♟️Its chairman is appointed by Speaker of LS.
♟️ *FUNCTION :*
To examine the annual audit reports of the CAG. CAG acts as a guide, friend, philosopher of the committee.

*♟️Limitations :*
It is not concerned with the questions of policy in broader sense.
♟️Its recommendations are advisory and not binding on the ministries.
♟️It conducts a post-mortem examination of accounts.

🛡 *CENTRE-STATE ADMINISTRATIVE RELATIONS*

*Article 256 —* Obligation of states and the Union

*Article 257 —* Control of the Union over states in certain cases

*Article 257A —* Assistance to States by deployment of armed forces or other forces of the Union (Repealed)

*Article 258 —* Power of the Union to confer powers, etc., on states in certain cases

*Article 258A —* Power of the states to entrust functions to the union.

*Article 259 —* Armed Forces in States in Part B of the First Schedule (Repealed)

*Article 260 —* Jurisdiction of the Union in relation to territories outside India

*🛡️Features Of Fundamental Duties*

♟️Some of them are moral duties while others are civic duties.

For instance, cherishing noble ideals of freedom struggle is a moral precept and respecting the Constitution, National Flag and National Anthem is a civic duty.

♟️They refer to such values which have been a part of the Indian tradition, mythology, religions and practices.

♟️Fundamental Duties are confined to citizens only and do not extend to
foreigners.

♟️Fundamental duties are non-justiciable. The Constitution does not provide for their direct enforcement by the courts.

🛡️ Swaran Singh Committee

♟️In 1976, Congress Party set up the Sardar Swaran Singh Committee to make recommendations about fundamental duties, the need felt during the operation of the internal emergency (1975–1977).

♟️The committee recommended the inclusion of a separate chapter on fundamental duties in the Constitution.

♟️It stressed that the citizens should
become conscious that in addition to the enjoyment of rights, they also have certain duties to perform as well.

♟️The Congress Government at Centre accepted these recommendations and enacted the 42nd Constitutional Amendment Act in 1976.

♟️This amendment added a new part, namely, Part IVA to the Constitution. This new part consists of only one Article, that is, Article 51A.

♟️Though Swaran Singh Committee suggested eight Fundamental Duties in the Constitution, the 42nd Constitutional Amendment Act (1976) included ten Fundamental Duties.

🛡️ Meaning Of Judicial Activism

♟️Judicial activism denotes the proactive role played by the judiciary in the protection of the rights of citizens and in the promotion of justice in the society. In other words, it implies the assertive role played by the judiciary to force the other two organs of the government (legislature and executive) to discharge their constitutional duties.

♟️Judicial activism is also known as “judicial dynamism”. It is the antithesis of “judicial restraint”, which means the self-control exercised by the judiciary.

This is a heartfelt conversation between Sourav & Jalsa Ma’am, reflecting the struggles & solutions every judiciary aspirant faces.

🧑‍⚖ Sourav as "S": Prep Beginner (Full of dreams, but a bit unsure!)
⭐️Jalsa Ma’am as "J": The Mentor (A guiding light with wisdom from countless success stories!)

S: December feels overwhelming, Ma’am. Prelims is knocking on the door, and Mains feels far away yet so daunting.
J: सही कहा! ये हर aspirant का सबसे बड़ा dilemma है। कुछ लोग "integrated preparation" की सलाह देते हैं, लेकिन truth यह है – preparation integrated होनी चाहिए, लेकिन execution अलग-अलग होती है।

S: Ma’am, Prelims हमेशा unpredictable लगता है।
J: सही पकड़ा। Prelims ऐसा है जैसे एक तेज़ रफ़्तार वाली कश्ती में uneven पानी में तैरना। Factual, time-bound, और nerve-wracking! वहीं, Mains एक steady जहाज की तरह है – endurance, strategy और calmness चाहिए।

S: लेकिन sources तो एक जैसे ही पढ़ने हैं, है ना?
J: Sourav, think of it this way – Prelims is like a treasure hunt: quick recognition of facts hidden amidst distractions. Mains is like writing a story about how you found the treasure – detailed, analytical, & impactful!

S: मतलब Prelims का काम है दरवाजा पहचानना, और Mains उसे खोलने की कला है?
J: Exactly! Judiciary Prelims test करता है कि आप Bare Acts और facts को कितना sharp और सही से recognize करते हैं। Mains test करता है कि आप उन्हें कितनी clarity और structure में present करते हैं।

S: लेकिन overlapping topics का क्या करें?
J: Take Indian Evidence Act – Prelims में sec को spot करना सीखो, जैसे S.6 (Res Gestae) या S.32 (Dying Declaration). लेकिन Mains में सवाल आएगा – “S.32 hearsay evidence को कैसे safeguard करता है?” ये आपका depth of understanding और articulation test करेगा।
