📌 USCIS Updates Filing Procedures for Form I-140
USCIS is announcing through this FRN that employers whose labor certifications were processed in the (new) FLAG system must include a printed copy of the electronic Final Determination with their Form I-140, and that USCIS will consider this printed copy as an original, approved labor certification. The Final Determination must be completed and electronically signed by DOL, and must be signed by the foreign worker, employer, and the employer’s attorney or agent, if applicable.

📌 The Department of State completed a successful pilot program to renew of H-1B visas in the United States this year.  This allowed many specialty occupation workers from India to renew their visas without leaving the United States.  This pilot program streamlined the renewal process for thousands of applicants, and the Department of State is working to formally establish a U.S.-based renewal program in 2025.

Indian graduate student numbers increased by 19 percent to reach almost 200,000 students.

📌 Visa stamping: Centralized processing of nonimmigrant visa interview appointment
The U.S. Embassy and Consulates in India have centralized the processing of nonimmigrant visa cases to maximize productivity and increase efficiencies. This change is one of many measures we are taking to streamline visa processing and increase our capacity to meet Indian demand for travel to the United States.
H & L first time interview appointments have been principally centralized in Hyderabad.

B1/B2 interview waiver (drop box) appointments have been centralized in New Delhi

Regardless, of the location of the consular post for which the interview waiver appointment is scheduled, applicants can still submit their documents free of cost at any of the five Visa Application Centers in Chennai, Hyderabad, Kolkata, Mumbai, or New Delhi. Alternatively, for a fee of 850 rupees per application, applicants may submit their documents at any of the six Document Dropoff Centers located in Ahmedabad, Bangalore, Chandigarh, Cochin, Jalandhar or Pune.
Applicants, in some circumstances, may be required to appear for an in-person interview at the post where the visa processing has been centralized

U.S. Citizenship and Immigration Services today announced that any Form I-693, Report of Immigration Medical Examination and Vaccination Record, that was properly completed and signed by a civil surgeon on or after Nov. 1, 2023, does not expire and can be used indefinitely as evidence to show that the applicant is not inadmissible on health-related grounds.

📌USCIS Increases Automatic Extension of Certain Employment Authorization Documents to Improve Access to Work Permits
(A similar rule had expired last October, the new rule will be effective April 8th)

This temporary measure will apply to eligible applicants who timely and properly filed an EAD renewal application on or after Oct. 27, 2023, if the application is still pending on the date of publication in the Federal Register. The temporary final rule will also apply to eligible EAD renewal applicants who timely and properly file their Form I-765 application during a 540-day period that begins with the rule’s publication in the Federal Register.
