“As I discussed above, Chapter XXVII of the Sanhita has given wider protection to a person of unsound mind or a person suffering from intellectual disability. where two persons suffering from a mental disability or intellectual disability are dealt with differently, one under the Code, and the other under the Sanhita, it amounts to a violation of Article 14 of the Constitution. Among equals, the law should be equal and equally administered and should be treated alike. The guarantee of 'equal protection' under Article 14 is a guarantee of equal treatment of persons in 'equal circumstances'. To preserve the fundamental right of an individual, the provisions of the Sanhita can be extended retrospectively to any proceedings initiated prior to 1.7.2024.

In Shambhunath Singh (2001 (4) SCC 667), the Supreme Court of India has noted with great amount of dissatisfaction that the mandate of section 309 CrPC has been ignored by the trial courts and this has been a common practice in regular occurrence that the trial courts flout the said command with impunity. The Supreme Court of India held that the presiding officers of the each court need to chalk out methods to comply with legislative mandate of Section 309 of Cr.P.C

Now those who are saying justice is not done death penalty must be the only option, we I don't know whether death penalty should have been imposed on him or not however what I know is that this case was tried expeditiously and was given priority and if you see other similar cases with no limelight are still pending.

SC took suo motu, Authority ke dar se sub kuch possible hai.

Justice delayed is justice denied is not just because of infrastrucutre but also because of the will of pillars of the criminal justice system, if they have that zeal they can provide justice fairly and speedily as much they can.

P.S. I have no sympathy with convict but with victim and society at large.

The LGBTQ community not only faces gender inequality, violence, and harassment in India but also in different countries around the world. A few countries like Afghanistan, Brunei, Pakistan, Qatar, and UAE provide punishment in the form of the death penalty against homosexuality. Till the 20 century, homosexuality was never given recognition by the state as well as people and was recognized as a heinous crime or sin. In 1992, the WHO gave recognition to homosexuality and accepted it as normal human behavior which is then getting legal status among various countries. In 2011, UNHCR released its first report on human rights and the LGBTQ community that mentions the provisions and the rights of the community including criminalization of homosexuality, discrimination against social violence and bullying, and many more. The UN also urged all countries to enact laws related to the protection of the rights of the LGBTQ community. In 2015, several UN agencies (ILO, UNHCR, UNDP, UNESCO, etc.) initiated equality practices to end violence and gender inequality against LGBTQ people. Despite these efforts, the UN’s formal agencies face many obstacles in promoting awareness of the rights and protection dealing with homosexuality. In 2016, UNHRC established an expert council to formally examine the social atrocities towards the LGBTQ community but the UN Security Council members like China and Russia did not support this initiative. In 2016, the famous incident of the mass shooting at Pulse nightclub in Florida shook the roots of humanity that lead to the massacre of 49 people for practicing homosexuality. The court of Taiwan in 2018 held that it is an individual choice to maintain sexual relationships irrespective of gender and religion. The progress and awareness toward the protection of the rights of the LGBTQ community have witnessed a gradual change globally with an optimistic ray of hope while advocating for change at the International level."

The Court reasoned that when the 'transfer of possession' is implicit in contracts for the sale of immovable property under Section 55 of the Transfer of Property Act, 1882, even if possession is not explicitly sought, a suit for specific performance inherently involves elements that affect the property's location, making it a "suit for land." A suit for land is a suit in which the relief claimed relates to the title or delivery of possession of land or immovable property.

The Supreme Court observed that when possession of the immovable property is transferred implicitly upon execution of the sale deed, a separate suit seeking possession of the immovable property is not required under Section 22 of the Specific Relief Act, 1963 (“SRA”).

"The issue of registration of a document is with the State, which requires compulsory registration of documents so that it is not deprived of revenue by way of stamp duty payable on such transfers of immovable property. If the purchaser has no means to pay stamp duty or exorbitant demand of stamp duty is made by the registering authority which the purchaser is unable to pay at that time but he remains satisfied with the fact that the vendor has fairly and duly executed the sale deed presented it for registration and put him in possession of the purchased property which he is peacefully enjoying, he is always at liberty to pay the deficiency of stamp duty at any point of time. The document presented for registration will remain with the Registering Authority till such time, the deficiency is removed. However, this pendency of registration on account of deficiency cannot enure any benefit to the vendor, who has already eliminated all his rights by executing the sale deed after receiving the sale consideration. He cannot become the owner of the transferred land merely because the document of sale is pending for registration

When is the sale deemed to be duly executed?

Do you think the Judgment is correct, in my opinion the strict interpretation of Section is not applied here due to pragmatic situation and it sets an example to the vendors to not commit fraud with others, however the other point remains valid that the registration is not complete and sale is not executed it is a trite principle of law.

Important Judgments on Federalism

1. “I term the era before the judgment of the Supreme Court in SR Bommai v. Union of India as the centripetal era. Here, the Court adopted interpretations with a centripetal impact, that is, it had a centralizing tendency which led to an accumulation of power with the Center and away from the federating States.”
