भारत सरकार ने 2023 -24 के बजट में माइक्रो और स्माल उद्यमियों के हितों की रक्षा के लिए उनके द्वारा उपलब्ध कराई गई किसी भी वस्तु या सेवा के बिल का भुगतान 15 दिन या किसी एग्रीमेंट के कारण अधिकतम 45 दिन में करना अनिवार्य कर दिया है। *यदि किसी माइक्रो, स्माल उद्यमी का कोई भी भुगतान 31 मार्च की बैलेंसशीट में अनपेड रहता है, तो उतनी राशि क्रेता की आय में जुड़ जाएगी, और वास्तविक रूप से payment होने के वित्तीय वर्ष से अगले वर्ष में रिफंड हो पाएगी।*
इस प्रावधान के अनुसार कोई भी खरीददार चाहे वो माइक्रो -स्माल हो या नही, सरकार के पोर्टल पर रजिस्टर हो या नही, यदि उसने किसी माइक्रो या स्माल से कोई भी परचेज या सेवा ली है, उसका भुगतान उसे 15 दिन या किसी एग्रीमेंट (चाहे वो कितने भी लम्बे समय के लिए किया गया हो) अधिकतम 45 दिन में करना होगा।
*प्रत्येक CA का दायित्व होगा कि वो सरकार को ऐसी विलंबित (लेट) पेमेंट्स के बारे में आयकर विभाग को सूचित करें।*
सामान्य शब्दों में समझिए कि यदि आपके किसी माइक्रो स्माल सप्पलायर की 50 लाख की payment 31 मार्च की बैलेंसशीट में बाकी दिखती है, तो 50 लाख रुपये आपकी इनकम में जोड़ दिए जाएंगे, जिससे आपको 15 -17 लाख रुपये आपको इन्कमटैक्स के रूप में भरने होंगे। ये आपको उस वित्तीय वर्ष के अगले वर्ष में रिफंड मिलेंगे जब आप अपने सप्पलायर को भुगतान कर देंगे।
*इसलिए अभी से प्लानिंग करें, और 31 मार्च से पूर्व 45 दिन से अधिक की लंबित payment कर दें।
अपनी पार्टियों को भी सरकार के इस प्रावधान के बारे में सूचित कर दें, जिससे वो अपना नुकसान रोक सकें।

*Very Important Income Tax Update regarding Micro and Small Enterprises*
If payment for purchases made from *Micro and Small units* remains outstanding on 31st March, there may be huge tax liability. Therefore, plan from now on.
1. Deduction for purchases/expenses made from *micro and small enterprises* will be available only if payment is made to the supplier within the prescribed credit period (maximum – 45 days).
2. If no credit period has been fixed then in such case the payment terms will be considered only 15 days. Even if both parties agree, not more than 45 days will be allowed for this provision.
3. For example, if payment for your purchase (Raw materials/ Packing Material/CA Fees) worth 1 Crore is pending for more than 45 days on 31st March, then 1 Crore will be added to your income and There could be a tax liability of around Rs 30-35 lakh on it.
4. Micro enterprise means a firm whose investment in Plant and Machinery does not exceed Rs 1 Crore and turnover does not exceed Rs 5 Crore.
5. Small enterprise means a firm whose investment in Plant and Machinery does not exceed Rs 10 Crore and turnover does not exceed Rs 50 Crore.
6. If the payment is pending for more than 45 days but is made before the end of the financial year, then in such a case its deduction will be available in the same year.
7. If the payment is made after 45 days, then in that case its deduction will be available in the year in which the payment is made.
8. These provisions will be applicable on purchases made from such units whether the buyer is registered with MSME or not.
9. If during Income Tax Scrutiny it is revealed from the cross confirmation of the Income Tax Department that your supplier is a Micro or Small unit and his payment has been made after the time limit, then at that time also he can add the outstanding payment to the income. .
10. This provision has come into effect from the financial year starting 1/04/2023.
11. It is suggested that you mention your enterprise registration number and your category (Micro/Small/Medium) in your sale invoice so that the buyer can know your MSME status.
12. It has been analyzed that payments of group firms also remain outstanding, so keep this in mind also.
