โ๏ธThis established convention was violated in 1973 when A.N. Ray was appointed as the Chief Justice of India by superseding three senior judges.
โ๏ธAgain in 1977, M.U. Beg was appointed as the chief justice of India by superseding the then senior-most judge.
โ๏ธThis discretion of the government was curtailed by the Supreme Court in the Second Judges Case (1993), in which the Supreme Court ruled that the seniormost judge of the Supreme Court should alone be appointed to the office of the chief justice of India.

*๐ก๏ธDissolution*
โ๏ธRajya Sabha, being a permanent House, is not subject to dissolution. Only the Lok Sabha is subject to dissolution.
โ๏ธUnlike a prorogation, a dissolution ends the very life of the existing House, and a new House is constituted after general elections are held.
โ๏ธThe dissolution of the Lok Sabha may take place in either of two ways:
1. Automatic dissolution, that is, on the expiry of its tenure of five years or the terms as extended during a national emergency; or
2. Whenever the President decides to dissolve the House, which he is authorised to do. Once the Lok Sabha is dissolved before the completion of its normal tenure, the dissolution is irrevocable.

โ๏ธThe Constitution has declared Hindi and English to be the languages for transacting business in the Parliament. However, the presiding officer can permit a member to address the House in his mother-tongue. In both the Houses, arrangements are made for simultaneous translation.
โ๏ธThough English was to be discontinued as a floor language after the expiration of fifteen years from the commencement of the Constitution (that is, in 1965), the Official Languages Act (1963) allowed English to be continued along with Hindi.

โ๏ธ *Article 12 and applicability on United Nation (UN)* The Delhi High Court has ruled earlier that the UN is not a State under Article 12 and hence cannot be brought under the jurisdiction.
โ๏ธ *Article 12 and PM CARES fund* The Centre recently informed the Delhi High Court in a plea seeking to declare the fund a โstateโ under Article 12 that:
โ๏ธPM CARES Fund is set up as a public charitable trust and is not created under the Constitution or any law made by the Parliament or the state.
๐ *Judiciary under Article 12*
โ๏ธ *Judicial & Non-Judicial Function* When the Judiciary is discharging Judicial functions, it is not regarded as a State whereas the non-judicial function brings it under the definition of โStateโ.
*๐Related Cases*
โ๏ธ *Naresh Shridhar Mirajkar case (1966)* Judiciary should be put under the ambit of Article 12, otherwise the courts would be allowed to make rules which violate the fundamental rights of the citizens.
โ๏ธ *Rupa Ashok Hurra v. Ashok Hurra case (2002)* Superior courts of justice do not fall within the ambit of โstateโ or โother authoritiesโ under Article 12.

For instance, cherishing noble ideals of freedom struggle is a moral precept and respecting the Constitution, National Flag and National Anthem is a civic duty.
โ๏ธThey refer to such values which have been a part of the Indian tradition, mythology, religions and practices.
โ๏ธFundamental Duties are confined to citizens only and do not extend to
foreigners.
โ๏ธFundamental duties are non-justiciable. The Constitution does not provide for their direct enforcement by the courts.

๐ก๏ธRetired Judge
โ๏ธAt any time, the chief justice of India can request a retired judge of the Supreme Court or a retired judge of a high court (who is duly qualified for appointment as a judge of the Supreme Court) to act as a judge of the Supreme Court for a temporary period.
โ๏ธHe can do so only with the previous consent of the president and also of the person to be so appointed.
โ๏ธSuch a judge is entitled to such allowances as the president may determine.
โ๏ธHe will also enjoy all the jurisdiction, powers and privileges of a judge of Supreme Court. But, he will not otherwise be deemed to be a judge of the Supreme Court.

โ๏ธIn 1976, Congress Party set up the Sardar Swaran Singh Committee to make recommendations about fundamental duties, the need felt during the operation of the internal emergency (1975โ1977).
โ๏ธThe committee recommended the inclusion of a separate chapter on fundamental duties in the Constitution.
โ๏ธIt stressed that the citizens should
become conscious that in addition to the enjoyment of rights, they also have certain duties to perform as well.
โ๏ธThe Congress Government at Centre accepted these recommendations and enacted the 42nd Constitutional Amendment Act in 1976.
โ๏ธThis amendment added a new part, namely, Part IVA to the Constitution. This new part consists of only one Article, that is, Article 51A.

๐ฏSpeaker is the Presiding Officer of the Lok Sabha (Article 93) or Legislative Assembly (Article 178).
๐ฏThe Speaker is elected from among the members of the Lok Sabha / Assembly by a simple majority of all MPs/MLAs.
๐ฏArticle 179: Speaker has to vacate office if she ceases to be the member of the House.
๐ฏWhenever thee Lok Sabha or Assembly is dissolved Speaker shall not vacate his office immediately before the first meeting of newly elected Lok Sabha or Assembly Any MP or MLA can be nominated as a speaker, however the candidate of the ruling party or the party with the majority usually secures this position (Also a convention).

โ Article 280 of the constitution of India provides for a Finance Commission as a
quasi-judicial body.
โ It constituted by the president of India every fifth year or at such earlier time
as he considers necessary.
โ Finance Commission consists of a chairman and four other members to be
appointed by the president.
โ Function of the commission is to make recomendations to the president of India on following matters .
1. The distribution of the net proceeds of taxes to be shared between the centre and the states and the allocation between the states of the respective shares of such proceeds.
2. The principles that should govern the grants-in-aid to the states by Centre.
3. The measures needed to augment the consolidated fund of of the panchayats and the municipalities in the state on the basis of the recommendations made by
the state finance commission.
