Health Regulations case against Minister of Health by Att. Pillay & Adv. Sibanda

This group has been formulated on this case which is challenging the Minister on the constitutional grounds of discriminating 90% of the people of South Africa who were left out in the consultation process because their languages were excluded. It is also challenging Parliament on its failure to protect the rights of the people of South Africa where the application of executive powers is concerned.

The case against the Minister is being championed by Goab King Cornelius III of the Khoi khoi and Women of Justice.

In early July 2022, Goab King Cornelius asked the Minister to translate the regulations to KhoeKhoegoab and Afrikaans. The Minister totally ignored the correspondence and did not respond. Now the Court is being asked to compel him to respond to the King's letter. Other language groups are being asked to join the case.

The Applicants on the case are not funded; the King is not funded by government or any other entity and Women of Justice is a community based organisation with no funding.

There is need for them to raise funds for disbursements like service of process and also to help the Legal Team who are working pro-bono for this particular case, just as they did with the Action 4 Freedom case against the Minister of Health, to extend the public participation period to 3 months.

We request for those who may be in a position to help the Applicants to raise funds, to finance the case, through fundraising initiatives and/or contributions/donations to do so. The account number is stated below.

On the 5th of August 2022, Attorney Naven Pillay and Advocate Sibanda successfully served papers on the State for a main application advocating for the broader participation on the part of the members of public who are not English-speaking, with reference to the proposed National Health amendment regulations. Case number *13187/22*

An interdict was also served on 12 August 2022, to ensure that the promulgation of the amendments is apprehended, case number *13469/22*

Court hearing date will be announced as soon as confirmed.

The applicants are Gaob King Cornelius of the Khosian and Women of Justice.

As against the past where the rules of Court specifically allowed papers to be directly served on the State Attorney, now service needs be served on the Minister and Parliament first. The legal team needs to urgently engage the services of Deputy Sheriff and PostNet to serve the papers. Based on the Sheriff's costs on service of urgent papers on an urgent basis and also PostNet this can cost anything from *R3000-R4000* for urgent service in Pretoria and Cape Town.

The Minister of health plans to turn us into a Communist style dictatorship when he makes an emergency law part of the health act on August, 5th, 2022.
