Facts:
In the case of K.S. Periyaswamy Vs. State of Karnataka the petitioner, K.S. Periyaswamy, an advocate, filed a writ petition under Articles 226 and 227 of the Constitution of India. The petition sought a writ of mandamus directing the State of Karnataka to grant a 100% refund of court fees for cases settled through any of the modes of Alternative Dispute Resolution (ADR) as referred to in Section 89 of the Code of Civil Procedure, 1908. The petitioner argued that the existing provision under Section 66(1) of the Karnataka Court Fees and Suits Valuation Act, 1958, as amended by Act No. 9 of 2015, only allowed for a 75% refund, which was inconsistent with the provisions in other states and the recommendations of the Supreme Court in the Salem Advocates Bar Association case.

Case Analysis:
The petitioner highlighted that several states, including Andhra Pradesh, Tamil Nadu, Kerala, Maharashtra, and Goa, had amended their respective Court Fees Acts to allow for a 100% refund of court fees in cases settled through ADR. The petitioner argued that the Karnataka amendment, which only provided a 75% refund, was discriminatory and did not align with the Supreme Court's recommendations. The petitioner relied on the Supreme Court's judgment in the Salem Advocates Bar Association case, which emphasized the need for uniformity in court fee refunds across states to promote ADR mechanisms.

Conclusion:
The Karnataka High Court, presided by Chief Justice Abhay S. Oka and Justice Mohammad Nawaz, acknowledged the petitioner's arguments and the need for uniformity in court fee refunds to encourage ADR. The court directed the State of Karnataka to consider amending the Karnataka Court Fees and Suits Valuation Act, 1958, to provide for a 100% refund of court fees in cases settled through ADR, in line with the Supreme Court's recommendations and the practices in other states.

Daily Legal Judgements

*Facts*
The case revolves around a property dispute where Rajendra Kumar Gupta filed a suit against Neelam Gupta and others for the recovery of possession of a property. The property in question was purchased by Rajendra Kumar Gupta through a registered sale deed in 1968. The dispute arose when Neelam Gupta and others allegedly dispossessed Rajendra Kumar Gupta from the property in 1983. The High Court of Chhattisgarh had previously ruled in favor of Rajendra Kumar Gupta, which was challenged by Neelam Gupta and others in the Supreme Court.

*Case Analysis*
The Supreme Court examined whether the transfer of immovable property to a minor through a sale deed is valid. The appellants argued that such a transfer is void as it constitutes a contract with a minor, which is prohibited under the Indian Contract Act, 1872. However, the court clarified that a sale deed is not a contract but a conveyance of property. Therefore, the transfer of property to a minor is permissible under the Transfer of Property Act, 1882.

The court also addressed the issue of adverse possession claimed by the respondents. It was argued that the respondents had been in continuous possession of the property for over 12 years, thus acquiring ownership rights. However, the court found that the possession was not adverse but permissive, as the respondents were family members and had initially been allowed to stay on the property.

Conclusion:
The Supreme Court upheld the High Court's decision, affirming that the transfer of immovable property to a minor through a sale deed is valid. The court also rejected the claim of adverse possession by the respondents, stating that their possession was permissive and not adverse. This judgment clarifies the legal position on the transfer of property to minors and the concept of adverse possession in family disputes.
