The Mines and Minerals (Development and Regulation) Amendment Act, 2023 introduces significant reforms to India's mining sector, particularly concerning critical minerals essential for technological advancement and energy transition. The key amendments are as follows:

### 1. Private Sector Participation in Atomic Minerals

- Previous Provision: Exploration and mining of atomic minerals such as lithium, beryllium, niobium, titanium, tantalum, and zirconium were exclusively reserved for state agencies.

- Amendment: The Act now permits private sector involvement in mining these six atomic minerals, aiming to boost their exploration and production.

### 2. Centralized Auctioning of Critical Minerals

- Previous Provision: State governments were responsible for auctioning mining leases and composite licenses for minerals.

- Amendment: The central government is now empowered to exclusively auction mining leases and composite licenses for 26 critical minerals, including lithium, cobalt, and graphite, which are vital for electric vehicles and battery technologies.

### 3. Introduction of Exploration Licenses

- Previous Provision: There was no provision for auctioning exploration licenses.

- Amendment: State governments can now grant exploration licenses through competitive bidding, with the central government prescribing auction details. This initiative is designed to encourage private sector participation in the exploration of deep-seated and critical minerals.

### 4. Expansion of Permissible Exploration Area

- Previous Provision: A prospecting license allowed activities in an area up to 25 square kilometers.

- Amendment: The Act permits exploration activities under a single license in an area up to 1,000 square kilometers, with provisions for area retention after the initial three years.

### 5. Incentives for Exploration Licensees

- Previous Provision: The Act did not specify incentives for entities conducting exploration.

- Amendment: If resources are proven after exploration, the state government must auction the mining lease within six months. The exploration licensee will receive a share in the auction value of the mining lease for the mineral they prospected, incentivizing private investment in exploration activities.

These amendments are anticipated to enhance transparency, attract private investment, and accelerate the development of critical mineral resources in India, thereby reducing import dependence and supporting the country's economic growth and energy transition goals.
