Today Amrapali matter was taken up at court No 11
Supreme Court sought stats of compliance for order dated 3rd November 2024. NBCC tried sharing the report during the proceedings, which was countered by council of Home Buyers and Development Authorities. Bench directed NBCC to file the report with a copy to all parties.
With regards to IA filed by 2 associations namely Centurian Park Lowrise and Golf homes Kingswood, ML Lahoty council for Home Buyers sought courts intervention. Court Receiver Amrapali requested court not to engage in operations maintenance matters. He said due to groupism and different groups, the matter of maintenance and operations in completed projects remains troublesome and thus NBCC has been advised to take over maintenance and operations for such projects. ML Lahoty countered the claims and said, those 2 IA’s filed by him are not having any such issues, rather they seeks completion of what NBCC was entrusted upon by apex court. Thereby Court asked NBCC to file the reply on both the IA’s before the next date i/e 9th January 2025

In Amrapali Centurian Park + others matter, a Note was submitted by Receiver which Part II pertains to maintenance of the completed Projects of Amrapali. In the note it was suggested to the court that the Projects where 60% of occupancy is achieved, NBCC shall be deemed to have handed over the facilities and that the Home Buyers Associations shall take over the responsibility of maintaining the common facilities. Further, NBCC has called for tender for maintenance of other projects and the home buyers have to pay maintenance charges as intimated to them.
On this aspect, appearing for the Home Buyers, we have conveyed to the Court that we have to interact with our Home Buyer representatives and appropriate direction may be passed only thereafter, for which the court has agreed and listed the matter on 06th November, 2024
Apart from this No Application have been taken up for hearing by court. Court has made it clear they will take up applications only after NBCC related issues are over.
