If your habits don’t change you won’t have a new year, you will just have another year.

I insist upon you taking a small step at a time. Invest in yourself, build that strength to face the war in the exam hall on the 25th of May. And that strength would come with consistency ALONE.

Write answers daily. Mains stage is the deciding factor in the exam. Prelims is just a screening test which can be dealt with in a matter of 2 to 3 months. Be prepared for Mains till the end of February. Write guys, write a lot.
ONLY those of you who will write today, will be able to write the destinies of hundreds of people later.

For all of those confused with the topics enlistment for modern history answer writing program, please understand that Indian Freedom Struggle is incomplete without studying the role of Muslim League (the politics of which is mentioned in the TPSC syllabus)

If you look at the scheme of things we'll be dealing with, you won't even find a mention of the word CONGRESS OR INC until before 1930s. So does that mean we won't be dealing with the topic?

Of course not. Because without the role of Congress, freedom struggle is again incomplete as a topic to be prepared for any exam that demands preparation of Modern Indian History.

So rest assured, everything that's relevant and important, will find a place in the program.

Call it by any name, the history won't ever change.

Rules and Guidelines for the GS 3 Answer Writing Program

Submission Deadline:
The answer writing program is designed for your practice, and it is highly advisable to write daily to consistently improve and enhance your writing skills. Progress is minimal when you attempt to write multiple answers in one sitting. Therefore, answers must be submitted by midnight on the day the question is posted. Late submissions may or may not be reviewed, depending on SP Ma’am's availability.

Model answers will be provided the following morning. This approach ensures a more effective revision after 24 hours.

Evaluation Timeline: Evaluations will be provided within 2 days from the submission date.

Submission Format: Answers must be photographed and compiled into a PDF document for submission. Submissions in other formats will not be reviewed.

Margin Requirements for Evaluation: Failure to leave margins on both sides for comments and feedback will result in partial evaluation, as there will be no space for remarks to guide your improvement.

File Naming Convention: The PDF file should be named in the following format: NAME (in uppercase)–answer number–date in DD-MM-YY. Example: ARJUN-13-04-11-24.

File sharing: Share your Answer copies personally with SP ma'am. Please note that the link to share your answers will be provided exclusively to those candidates who enroll for the course.

Bye election
:

The legitimacy of by polls in India springs from the Representation of Peoples Act, 1956. ECI procures its source of authority from Sections 147, 149, 150, 151 and 151(A) of the Representation of Peoples Act, 1956.

As per section 151-A of Representation of Peoples Act, 1956 the bye-election should commence within 6 months from the vacancy, occurrence any of the following cases.
2. The death of any sitting member
3. Resignation
4. Absence for 60 days without permission of the house.
5. Contesting election from two eats and winning both the seats.
6. Disqualification as per 102(1), 102(2).
7. Voting Irregularities

As ECI is bound to hold bye-elections within six months from the date of arising of vacancy, but with exceptions:

1. When the remaining tenure of the member is less than 1 year.

2. When the ECI, in consultation with the Central Government certifies that it is difficult to hold bye-elections .

SECTION 6A OF THE CITIZENSHIP ACT 1955 HAS BEEN DECLARED CONSTITUTIONAL

The constitutional bench with 4:1 majority has declared the section as constitutional.

section 6A:
It is the result of accord was signed by the Rajiv Gandhi-led Central government with the representatives of the Assam Movement, including AASU and All Assam Gana Sangram Parishad (AAGSP).
Section 6A states that people of “Indian origin” who entered Assam before January 1, 1966 and have been “ordinarily resident” in the state. Those who came to Assam after January 1, 1966 but before March 24, 1971 were given the rights and obligations of Indian citizens but not allowed to vote for 10 years.

Arguments of Petitioner (Assam Sanmilita Mahasangha) :

1. It is against Article 14 because the cut off dates for other migrants from Pakistan was 19th July 1948 as per article 6 of the constitution.
2. It impacts their cultural rights maintained under Article 29.
3. It is also against the idea of Fraternity, maintained under Article 21.
4. It is against article 355 also as it puts unnecessary burden on centre to protect the States from external aggression and internal disturbance.

Centre's Argument:
Article 11 of the Constitution gives Parliament the power to make laws on citizenship including for a “particular object” without violating the right to equality.

Court's understanding:

1. Justice Chandrachud said: Article 6 does not cover a person who migrated from East Pakistan to Assam after 19th July 1948. Both Article 6 and section 6A deals with different timeframes. Therefore section 6A and Article 6 cant be read together. Justice Kaul further added that Parliament under article 11 is authorised to grant citizenship and determine cut off dates and court cant intervene in this and anyway section 6A is meaningless for those who entered after 25th March 1971 because in any case they will be treated as Illegal Immigrants.

2. Judges maintained that article 355 is in Part 18 of the constitution which does not maintain rational ground of relation with something mentioned in Part 2 (Citizenship) of the constitution.

3. It is also not against Article 29 as only Assamese culture need not be seen as exclusive culture as in Assam there are mix of cultures today. And for Article 29, petitioners will have to prove that ethnic group could no longer protect their culture or language due to the presence of another group.

Justice Pardiwala has made dissenting remark on following grounds:

1. He said there are two categories of immigrants: those who entered before January 1966 and those between January 1966 and match 1971. This cut off date was decided to check wrongful inclusion of immigrants in the electoral roll. But the issue is timely exercise of finding wrong inclusion has not been done.

2. Secondly there were no mechanism for registration of individuals who have entered between 1966 and 1971.It incentivises the migrants to continue to remain on electoral roll for indefinite time and (No Voting rights for 10 years does not hold any importance).

History of Environmental law in India

The genesis of environmental jurisprudence in India goes back to 1972 when India became signatory to Stockholm declaration. The declaration held that urban development must be carried out in inclusive manner which resulted into environment legislation in India.

1. The first law water prevention and control of pollution act was passed using article 252 in 1974 and then air prevention and control of pollution act in 1981using article 253 of the constitution.

2. The environmental protection act was passed on 1986 that enables central govt to take any measures to protect the environment.

3. By the delegated legislation under environment protection act, Environmental impact assessment was notified in 2006 which makes environmental clearance mandatory for the project mentioned in schedule of the environment protection act.

5. In 2011, coastal regulations zone notification was issued under section 3 of the act that regulate construction along the coast.

5. National biodiversity act 2002 was passed for conservation of biodiversity, sustainable use of its components and equitable sharing of benefits arising out of the utilization of biological resources.

SC in Vellore citizen welfare forum has mentioned- Every one has the right to fresh air, water and pollution free environment. And court also recognised the principal of sustainable development.

Double Taxation Avoidance Agreement (DTAA) between India and Mauritius has been amended to include Principal Purpose Test (PPT). PPT means the tax benefits under the treaty will not be applicable if it is established that obtaining that duty benefit was the principal purpose of any transaction or arrangement.

Let us understand with an example.

Suppose an Foreign Portfolio Investor (FPI) registered in Mauritius purchased shares of an Indian listed company. Now when the FPI receives dividend (or if it sells shares then it may realize capital gain) then India may also impose tax on dividend (or capital gain tax) and when the FPI receives that income in Mauritius then Mauritius Govt. may also impose tax which results in Double Taxation. Now to avoid such double taxes (referred as tax benefits), India and Mauritius has signed Double Taxation Avoidance Agreement (DTAA).

But the Principal Purpose Test (PPT) says that if this transaction was done only to obtain duty benefit (tax avoidance) then the tax benefits will not be applicable to the investors. And this is in line with the global Base Erosion Profit Shifting (BEPS) framework.

Withholding tax is nothing but Tax Deducted at Source (TDS) in case of international transactions.

Law of Privacy

The apex court in Puttaswamy judgement has made Privacy a FR under article 21. (The case was filed relating to Aadhar becoming mandatory for gaining access to the benefits state welfare scheme) But this case presents a classic example of tug of war between literal and purpose interpretation by the court.

Literal interpretation can be drawn from the courts argument in A K Gopalan case where court said FR are having  mutually exclusive existence and they don't overlap and same interpretation has been followed in previous privacy case like MP Sharma vs Satish Chandra.

However the purpose of interpretation can be deduced from RC Cooper case where the court said FR are a bundle of rights and do not exist in isolated watertight compartments. In fact in Menaka Gandhi case court provided the idea of golden triangle ie, legality of every law should be tested on the touchstone of article 14,19,21 (Golden triangle).

Justice Chandrachud in Puttaswamy case said- Privacy is an element of human right and inalienable natural right. However it is not an absolute right, but it cannot be impinged without a just fair and reasonable law, this every action of the State is to be tested on the anvil of "Test of Proportionality":

1. Legality:- the action must be sanctioned by law.
2. Necessity:- The proposed action must be necessary.
3. Proportionality:- The extent of such interference must be proportionate.
4. Procedural guarantees:- Against abuse of interference.

In this case court upheld Aadhar act 2016 but struck down section 57 of the act which failed test of Proportionality. Section 57 says:- It allows government entities, body corporate and individuals to use the Aadhar number for establishing identity of an individual for "any purpose". The Apex court had an issue with any purpose, and considered this section null and void.

The Nobel Committee announced on October 7 that the Nobel Prize for Medicine or Physiology would be shared by Victor Ambros and Gary Ruvkun “for the discovery of microRNA and its role in post-transcriptional gene regulation,” thereby unlocking a secret on how different types of cells develop.

What is microRNA?
The human body is probably the most complex puzzle that humans are still trying to make sense of. Every time there is a better understanding and a piece slides into place with a resounding click, then it is an occasion for celebration. For a Nobel Prize too perhaps. This year’s awardees of the Nobel Prize for Medicine — Ambros and Ruvkun — did slide in a couple of pieces into the right slots in the massive puzzle that suddenly opened our eyes to understanding how different cell types develop.

Federalism and COVID:
GRANVILLE AUSTIN remarks:- Despite a strong centre, cooperative federalism does not necessarily result into weaker states, rather progress of the republic restes upon active cooperation between the two.
On the same line, Prashant Bhushan and shyam Agarwal talks about the need of "Scientific cooperative federalism".

It is important to discuss in this context about top down approach in tackling COVID pandemic. During lockdowns centre has issued guidelines from time to time under Disaster management act. The question is "Public health and sanitation" is a specific field of legislation under entry 6 of list II while disaster management is the residuary subject.

The centre could have applied Epidemic disease act which has the objective of preventing the spread of dangerous epidemic diseases. Under this act state governments is empowered to take appropriate measures. And actually this act would have been applied because disaster management act is not for inter state spread of contagious disease.

In this context John S Mill had said:- Management of free institutions requires conciliation, a readiness to compromise, willingness to concede something to opponents and mutual give and take. So state should not been seen as appendages to the centre, but as a real carrier of Indian team.

In IPC, Marital rape is not an offence because of exception to the definition of rape ( exception 2 of section 375 of IPC).

Why marital rape should be considered as rape?
Ans:-
1. It is contrary to the provisions of article 21, and 14.

2. In Joseph shine case, SC held offence of adultery as unconstitutional on the ground that women is not the property of her husband.

3. It is protected on the ground that Marriage is sexual relationship, thus determining the validity of marital rape allegations would be difficult. Then how one can reconcile the fact that this gives power to husband to rape her.

Why it is not criminalised?
1. It will destroy the institution of marriage.

2. It will be very easy for wife to allege the husband.

3. Difficult for court and investigation team to establish the fact which happened within closed room.

Conclusion: Consent in sexual relationship is very important, be it pre or post Marriage.

The Constitution considers marriage as an association of equals and does not in any sense depict women to be subordinate to men and guarantees women the fundamental rights under Articles 14, 15, 19 and 21 the right to live with dignity, personal liberty, bodily integrity, sexual autonomy, right to reproductive choices, right to privacy, right to freedom of speech and expression.
