◾️Section 223 (1) provides for the following:

▪️Examination of Complainant & Witnesses:

👉 A Magistrate taking cognizance of an offence on a complaint must examine the complainant and witnesses under oath.

👉 This examination is recorded in writing and signed by all parties, including the Magistrate.

▪️Opportunity for the Accused:

👉 Cognizance cannot be taken without giving the accused an opportunity to be heard.

▪️Exceptions to Examination Requirement:

🔻 The Magistrate need not examine the complainant and witnesses if:

👉 The complaint is made by a public servant in an official capacity or by a court.

👉 The case is transferred to another Magistrate under Section 212.

▪️No Re-examination on Case Transfer:

👉 If a case is transferred after initial examination, the new Magistrate need not re-examine the complainant and witnesses.

▪️ Section 223 (2) further provides for the following:

🔻Cognizance of a complaint against a public servant for acts done in official capacity requires:

👉 The public servant is to be given an opportunity to explain the situation.

👉 A factual report from a superior officer regarding the incident.

🔻 Status of Hijab Wearing in India

▪️ Amna Bint Basheer v CBSE, 2016: In Amna Bint Basheer v CBSE, 2016, the Kerala HC ruled that wearing a hijab is an essential religious practice but upheld the CBSE dress code, allowing additional measures and safeguards as in 2015.

👉 The Central Board of School Education (CBSE) argued that the dress code was to prevent unfair practices.

▪️ Kerala High Court, 2018: In Fathima Thasneem v State of Kerala, 2019, the case involved two girls who wanted to wear the headscarf and the Christian missionary school refused to allow the headscarf.

👉 The court ruled in favour of the school's decision, stating that the "collective rights" of the school must take precedence over individual student rights.

▪️ Resham v. State of Karnataka, 2022: Karnataka HC in March 2022, validated the state government's ban on hijabs in government colleges.

👉 HC upheld the ban stating that wearing a hijab did not qualify as an essential religious practice and the ban did not violate the Freedom of Speech and Expression.

▪️ Split Verdict by Supreme Court (SC), 2022. In Resham v. State of Karnataka, 2022 case 2-judge bench of SC delivered a split verdict. The case has now been referred to a larger bench of the SC.

◾️ Constitutional Framework for Religious Freedom in India : The Indian Constitution guarantees the Right to Freedom of Religion under Articles 25-28, enshrined in Part III (Fundamental Rights):

▪️ Article 25(1): Ensures the "freedom of conscience and the right to freely profess, practice, and propagate religion," providing a negative liberty where the state cannot interfere with religious practices.

▪️ Article 26: Grants the "freedom to manage religious affairs," allowing religious denominations to establish and manage institutions for religious and charitable purposes, subject to public order, morality, and health.

▪️ Article 27: Prohibits the state from compelling citizens to pay taxes for promoting or maintaining any particular religion, reinforcing the principle of secularism.

👉 Additionally, Articles 29 and 30 safeguard the cultural and educational rights of minorities, emphasizing the protection of their unique identities.

हेनले पासपोर्ट इंडेक्स 2025
हाल ही में जारी हेनले पासपोर्ट सूचकांक 2025 के अनुसार, दुनिया के सबसे शक्तिशाली पासपोर्ट की सूची में भारत पिछले साल के 80वें स्थान से फिसलकर 85वें स्थान पर आ गया है। सिंगापुर ने दुनिया के सबसे शक्तिशाली पासपोर्ट के रूप में अपना दर्जा बरकरार रखा है। संयुक्त राज्य अमेरिका के पासपोर्ट की रैंक 2024 में 7वें स्थान से गिरकर 2025 में 9वें स्थान पर आ गई है।

ब्लैक्स लॉ डिक्शनरी के अनुसार, "डॉक्ट्रिन ऑफ रिलेशन बैक" का अर्थ है, "ऐसा सिद्धांत जिसमें वर्तमान में किया गया कोई कार्य पहले के समय में किया गया कार्य माना जाता है।"
इसका तात्पर्य है कि वर्तमान में किए गए कार्य को पूर्व में किए गए कार्यों से जोड़ा जा सकता है।

👉 यह सिद्धांत विभिन्न कानूनों में भिन्न रूप से लागू होता है।

विभिन्न कानूनों में अनुप्रयोग:

👉 सीपीसी (CPC) के तहत:
डॉक्ट्रिन ऑफ रिलेशन बैक को कोड ऑफ सिविल प्रोसीजर की ऑर्डर VI रूल 17 के तहत निहित माना गया है। इसके अनुसार, यदि आवश्यक हो तो अदालत मुकदमे के मुद्दों को सुलझाने के लिए किसी पक्ष को उसके दावे (प्लीडिंग) में संशोधन करने की अनुमति दे सकती है।

👉 भारतीय अनुबंध अधिनियम (ICA):
इस सिद्धांत का अनुप्रयोग भारतीय अनुबंध अधिनियम की धारा 196 में "पृष्ठस्वीकृति" (Ratification) की अवधारणा में देखा जा सकता है।

👉 सीमाएं अधिनियम, 1963:
लिमिटेशन एक्ट, 1963 की धारा 21 स्पष्ट रूप से बताती है कि पक्षकारों के प्रतिस्थापन या उनके जोड़ने पर "डॉक्ट्रिन ऑफ रिलेशन बैक" लागू होगा।

#Doctrine

◾️ Doctrine of Relation Back : As per the black’s law dictionary the doctrine is defined as ‘a principle that an act done today is considered to have been done at an earlier time’.
It means an act done by a person in the present can be linked with the previous acts.

👉 The doctrine has different applicability with the different laws.

▪️Objective:

👉 The doctrine is useful for removing ambiguity at the time of delivery of justice.

👉 It helps to avoid limitations and restrictions in a case.

👉 It further reduces the chances of making mistakes.

👉 The doctrine of relation back is impliedly given under Order VI Rule 17 of the Code of Civil Procedure. It provides that a court can allow a party to a suit to amend the pleadings at any time before the trial, if it is necessary to determine the issues between the parties.

👉 The application of the doctrine of relation back under the ICA can be found in the concept of ratification given under Section 196 of the ICA (Indian Contract Act).

👉 Section 21 of the Limitation Act, 1963 clearly provides that the substitution or addition of parties will be governed by the doctrine of relation back.

◾️ Private Members Bill: Private Members' Bills are proposed by MPs who are not Ministers (i.e., not part of the government), allowing them to introduce laws or amendments on issues important to their constituencies.

▪️Key Features: Only non-government MPs can introduce these bills, offering a chance for Independent legislative proposals.

👉 MPs can also introduce resolutions to call attention to specific matters.

🔻Procedure:

▪️Drafting and Notice: MPs draft and submit bills with at least one month's notice.

▪️Introduction: Bills are introduced in Parliament, followed by initial discussions.

▪️Debate: If selected, bills are debated, typically in limited Friday afternoon sessions.

▪️Decision: Bills may be withdrawn or proceed to a vote.

▪️ Significance: These bills provide a platform for MPs to express themselves without party pressure, often on crucial or controversial matters.

👉  A historical example is the bill introduced by H.V. Kamath in 1966 after the death of Prime Minister Lal Bahadur Shastri, seeking to amend the Constitution to make only Lok Sabha members eligible for the post of Prime Minister.

👉  Only 14 Private Members' Bills have been passed since independence, and none have passed since 1970.

👉 The Rights of Transgender Persons Bill, 2014, became the first private member's bill approved by the Rajya Sabha in 45 years but lapsed without reaching the Lok Sabha.

भारत के पूर्व प्रधानमंत्री डॉ. मनमोहन सिंह का गुरुवार, 26 दिसंबर 2024 को निधन हो गया। 92 वर्षीय डॉ. मनमोहन सिंह को स्वास्थ्य बिगड़ने के बाद गुरुवार शाम एम्स, नई दिल्ली में भर्ती कराया गया था, जहां इलाज के दौरान उन्होंने अंतिम सांस ली। एम्स नई दिल्ली ने मनमोहन के निधन की पुष्टि करते हुए न्यूज बुलेटिन जारी किया है। एम्स ने कहा, "अत्यंत दुःख के साथ हम भारत के पूर्व प्रधानमंत्री डॉ. मनमोहन सिंह के निधन की सूचना देते हैं। उन्होंने 92 वर्ष की उम्र में अंतिम सांस ली। वे उम्र से संबंधित बीमारियों के कारण उपचाराधीन थे और 26 दिसंबर 2024 को घर पर अचानक बेहोश हो गए थे। घर पर ही उन्हें तुरंत पुनर्जीवित करने के उपाय शुरू किए गए। उन्हें रात 8:06 बजे एम्स, नई दिल्ली के मेडिकल इमरजेंसी में लाया गया। तमाम कोशिशों के बावजूद उन्हें बचाया नहीं जा सका और रात 9:51 बजे उन्हें मृत घोषित कर दिया गया।"

पूर्व प्रधानमंत्री मनमोहन सिंह का गुरुवार (26 दिसंबर 2024) को निधन हो गया. 92 साल के मनमोहन सिंह को गुरुवार को ही दिल्ली एम्स में भर्ती कराया गया था. उन्हें सांस लेने में तकलीफ थी. इस हस्तियों ने मनमोहन सिंह को श्रद्धांजलि दी और गहरा दुख जताया है.

Police said the woman invited the 24-year-old man, who works as a building contractor, to a room in a guesthouse in Muzaffarnagar on Sunday afternoon and attacked him with a "sharp object".

While Ahtesham Ahmed has been admitted to a hospital in Meerut and is said to be in critical condition, the accused, Heena, was taken into custody for questioning, police said, adding that she also attempted to harm herself.

Muzaffarnagar (city) DSP Vyom Bindal said, "The woman sustained injuries to her hand and both were taken to hospital. The man was shifted to Meerut. Preliminary probe suggests the couple, who belongs to Kulheri under Charthawal limits, had been in a relationship for almost eight years. The woman told us that her partner had recently fixed his marriage elsewhere and they had a heated argument over the matter."

राष्ट्रीय उपभोक्ता दिवस: 24 दिसंबर
राष्ट्रीय उपभोक्ता दिवस हर साल 24 दिसंबर को मनाया जाता है। इस दिन का उद्देश्य उपभोक्ताओं के अधिकारों और जिम्मेदारियों के प्रति जागरूकता बढ़ाना है।

ऐतिहासिक महत्व: यह दिन उपभोक्ता संरक्षण अधिनियम 1986 की याद दिलाता है, जिसे 24 दिसंबर 1986 को राष्ट्रपति की मंजूरी मिली थी।

उपभोक्ता संरक्षण अधिनियम, 2019: इस अधिनियम को उपभोक्ताओं के हितों की रक्षा के लिए और उनके साथ होने वाली धोखाधड़ी रोकने के लिए बनाया गया था. यह अधिनियम 20 जुलाई, 2020 से लागू हुआ था. इस अधिनियम के तहत केंद्रीय उपभोक्ता संरक्षण प्राधिकरण (सीसीपीए) का गठन किया गया था. सीसीपीए का मकसद उपभोक्ताओं के अधिकारों के उल्लंघन, अनुचित व्यापार प्रथाओं, और झूठे या भ्रामक विज्ञापनों से जुड़े माम
