Can We Oppose the Opinion of the Jumhūr - Sheikh Al-Albani

السائل : مخالفة رأي الجمهور ؟
Questioner: Opposing the opinion of the Jumhūr (the majority of scholars)?

الشيخ : مخالفة رأي الجمهور للدّليل ؛ فأمر واجب ،
Sheikh: Opposing the opinion of the Jumhūr for the dalīl (textual evidence i.e., Quran and Sunnah) is obligatory.

أما بدون دليل ؛ فلا شك أن النفس تطمئن للأكثرية أكثر من الأقلية ،
As for without a dalīl, then there is no doubt that the soul feels more reassured with (following) the majority than the minority.

إذا كان هناك دليل فالواجب اتباعه ، سواء كان موافقًا لرأي الجمهور أو الأكثرية ، أو مخالفًا ،
If there is a dalīl, then it is obligatory to follow it, whether it is in accordance with the opinion of the jumhūr or majority, or in opposition (to it).

أما إذا لم يكن ثمَّة دليل ؛ فالإنسان كما يشعر كل واحد منا أن رأي الأكثرية تطمئن إليه النفس أكثر من الأقلية ،
However, if there isn't a dalīl, then a person, like how each of us feels, is more reassured with the opinion of the majority than the minority.
الأصل إذًا هو اتباع الدليل من الكتاب والسنة ،
So, the fundamental principle is to follow the dalīl from the Kitāb and Sunnah.

فإذا لم يوجد الدليل عند طالب العلم فالنفس تطمئن لاتباع رأي الجمهور،
Ao, if there is no dalīl with the student of knowledge, then the soul is reassured by following the opinion of the Jumhūr.

لكن لو خالفنا رأي الجمهور إلى رأي الأقلية لأن النفس اطمأنت لرأي الأقلية ؛ فلا بأس من ذلك لقوله - عليه السلام - : (استفت قلبك وإن أفتاك المفتون)
However, if we oppose the opinion of the Jumhūr for the opinion of the minority because the soul is reassured by the opinion of the minority, then there is no problem with that because of his saying (the Prophet’s ﷺ ) "Consult your heart, even if the muftis issue you fatāwā."

For who is the Tūbā in the hadith 'Tūbā for the Strangers' - Sheikh Al-Albani


  نعود لنفقه ونفهم لمن تكون هذه الطوبى ،
We will repeat so that we comprehend and understand for who is this tūbā (glad tidings/paradise).

قال عليه السلام في حديث آخر : ( قالوا له من هم الغرباء قال هم الذين يصلحون ما أفسد الناس من سنتي من بعدي )
The Prophet ﷺ said in another hadith: They (the Companions) asked him: Who are the strangers?, he said: "They are those who rectify what people have corrupted from my sunnah, after me."

اللهم آمين قولا وعملا ،

قال ( هم الذين يصلحون ما أفسد الناس من سنتي من بعدي )
He said: "They are those who rectify what people have corrupted from my sunnah, after me."

في حديث آخر قال : ( هم ناس قليلون صالحون بين ناس كثيرين من يعصيهم أكثر ممن يطيعهم )
In another hadith, he said: "They are a small number of righteous people among a large number of people. Those who disobey them are more than those who obey them."

لذلك على الحريصين أن يكونوا من الغرباء الذين لهم طوبى وحسن مآب
That's why, it is upon those who are keen/determined, to be from the strangers for whom is tūbā and beautiful place of (final) return,

أن يصبروا على مجابهة الأخطاء ومعاشرة الناس الذين لا تطيب لهم إحياء السنن ، وإماتة البدع
that they be patient upon confronting the mistakes and living amongst people who are not pleased with reviving the sunnah and making bid'ahs perish.

The Innovation that Making Hajj on Foot is Better - Sheikh Al-Albani

‎لقد كان سيد البشر عليه الصلاة والسلام أقوى الرجال ،
Most certainly, the master of mankind ﷺ was the strongest of men.

‎وكان باستطاعته أن يحج من المدينة إلى بيت الله الحرام على الأقدام ،وكذلك سائر أصحابه الكرام ،
And he had the ability to do Hajj from Madīnah to the Sacred House of Allāh (Makkah) on foot, likewise all of his noble companions.

‎ لكنهم لم يفعلوا شيئًا من ذلك ،
However, they did not do any of that.

‎ وإنما حج رسول الله صلى الله عليه وسلم على ناقته كما هو معلوم ،
The Prophet ﷺ only did Hajj on his she-camel as is well-known.

‎فمن ذا الذي يستطيع أن يدعي بأن النبي صلى الله عليه وآله وسلم لم يكن عنده تلك الرغبة الجامحة في التقرب إلى الله بما شرع ،
So, who is able to make the claim that the Prophet ﷺ did not have that strong desire to get closer to Allah with what He legislated (i.e., what is favored),

‎فترك الحج على الأقدام وهو مستطيع ؟!
and he left making Hajj upon foot whilst he was able!?

‎وهو في زعم هذا المُحدث الحج على الأقدام أفضل ،
And in the claim of this innovator, making Hajj on foot is better.

‎ هنا تصبح هذه القضية بدعة ؛
Here this issue becomes a bid'ah (innovation in religion).

‎لأنه اقترن فيها قصد العبادة بأمر لم يشرعه الله - تبارك وتعالى - على لسان نبيه صلى الله عليه وسلم، أو على بيانه الذي يشمل الفعل أيضًا ،
That's because he intended worship in a matter that Allāh - tabaraka wa ta'ala - did not legislate upon the tongue of his Prophet ﷺ or through his clarification which also includes actions.

‎بخلاف إذا ركبنا اليوم الطائرة ، الطائرة بلا شك مُحدثة ، لكن هي تدخل في المصالح المرسلة ؛
As opposed to if we boarded a plane today, the plane without doubt is something new. However, this is included in al-masalih al-mursalah (lawful means).

‎لأنها تُسهِّل على الناس الحج إلى بيت الله الحرام .
That's because it makes it easy for the people to perform Hajj to the Sacred House of Allah.

The Innovation that Making Hajj on Foot is Better - Sheikh Al-Albani

Ruling of Affiliating to Other than the Salaf - Sheikh Al-Albani

‎الشيخ : ... حيثما ذهبت لو قلت لإنسان ما تعرفه : شو مذهبك ؟
Sheikh: Wherever you go, if you were to ask a person whom you don't know: "What is your Madh-hab?"

‎ ماذا يقول لك ؟ حنفي ، شافعي ، مالكي ، حنبلي ، شيعي ، زيدي ، إلى آخره . طيب ،
What would he say to you? Hanafī, Shāfi'ī, Mālikī, Hanbalī, Shī'ī, Zaidī, etc.. Okay

‎ لماذا أنتم تحرصون على اسم السلف ؟
Why are you eager upon the name of “Salaf”?

‎(- وهذه النسبة التي أنا أعتقد أنه لا يجوز لمسلم أن يتبرَّأ من هذه النسبة - ؛-
And this affiliation, that I believe is not permissible for any muslim to dissociate from this affiliation.


‎ لأن التبرُّؤ من هذه النسبة هو من مشاققة الله والرسول التي جاء ذكرها في القرآن الكريم ،
That is because dissociation from this affiliation, is a part of opposing Allah and the Messenger which is mentioned in the Noble Qur'ān.

‎ وهو قوله - تعالى - : { وَمَن یُشَاقِقِ ٱلرَّسُولَ مِنۢ بَعۡدِ مَا تَبَیَّنَ لَهُ ٱلۡهُدَىٰ وَیَتَّبِعۡ غَیۡرَ سَبِیلِ ٱلۡمُؤۡمِنِینَ نُوَلِّهِۦ مَا تَوَلَّىٰ وَنُصۡلِهِۦ جَهَنَّمَۖ وَسَاۤءَتۡ مَصِیرًا }
[سُورَةُ النِّسَاءِ: ١١٥]

And it is the Saying of Allah the Exalted (the meaning of which is) "And whoever contradicts and opposes the Messenger (Muhammad ﷺ) after the right path has been shown clearly to him, and follows other than the believers' way. We shall keep him in the path he has chosen, and burn him in Hell - what an evil destination." [Surah An-Nisā: 115]

Ruling of Affiliating to Other than the Salaf - Sheikh Al-Albani

Is Everything that Happened During the Time of the Prophet ﷺ Considered as Sunnah - Sheikh Al-Albani

وبهذه المناسبة أريد أن أذكِّر بأنه إن وقع شيء في عهد النبي - صلى الله عليه وآله وسلم - وبحضور منه أو هو فعله فكل ذلك إنما يدلُّ على جواز ما وقع،
On this occasion, I would like to remind (you) that if something happened during the time of the Prophet ﷺ, in his presence, or it was his action, then all of that only indicates that what happened is permissible.

ولا يدلُّ ذلك على أن ذلك سنة ينبغي على المسلمين أن يعتادوها وأن يلتزموها ،
It does not indicate that it is a sunnah that is necessary for the Muslims to make a custom and adhere to.

لأن الأمر لو كان كذلك لَالتزمها أول من التزم هو الذي بيَّن لنا شرعية ذلك وهو رسول الله ،
That is because if the matter was like that, the first one to adhere would be the one who explained to us the legislation of that (matter) - and he is the Messenger of Allah ﷺ.

ثم بالتالي لَالتزمَها أحرص الناس على اتباع الرسول - صلى الله عليه وسلم - ؛
Subsequently, it would have been adhered to by the most eager of people in following the Messenger ﷺ;

ألا وهم الصحابة، ثم التابعون، ثم أتباعهم.
they are the Companions, then those who followed them, then those who followed them.
