New Law on FIR Registration - Om Prakash v. State of Maharashtra (2025)

In a significant ruling, the Supreme Court of India in OM PRAKASH V. STATE OF MAHARASHTRA (JANUARY 16, 2025) has outlined a new process for registering an FIR when the police officer refuses to do so.

🔑 Key Highlights:
◽ Step 1: If a police officer refuses to register an FIR based on a complaint, the complainant must first make an application to the Superintendent of Police.
◽ Step 2: If the Superintendent of Police also fails to take action, the complainant may approach the court with a copy of the application submitted to the Superintendent of Police.
◽ Step 3: The Magistrate will then summon the Police Inspector to explain the refusal to register the complaint.
