🔆 Women in Judiciary Matters

In a recent speech, the erstwhile Chief Justice of India N.V. Ramana said the appointment of women judges should not be reduced to a mere “symbolic gesture”.
The CJI said the court would definitely benefit from the rich experience and nuanced understanding of the law women judges bring to the table.
The Judiciary acts as a protector of rights of the citizens guaranteed by the law of the land and the constitution.
The court can declare any law which transgresses a fundamental right as invalid.
In India the judiciary has the power to issue writs in the name of habeas corpus, prohibition, mandamus, quo warranto and certiorari.

▪️Present scenario in India:
Justice B.V. Nagarathna expected to be India’s first woman Chief Justice of India in September 2027.
Justice Fathima Beevi, who was appointed as the first woman Supreme Court judge in October 1989 nearly six months after her retirement from the Kerala High Court, and Justice Indu Malhotra, who was the first woman advocate be directly elevating as Supreme Court judge, individually creating history.
But their time on the Apex Court Bench was less than three years.
Justices Ranjana P. Desai and Gyan Sudha Misra were Apex Court judges for less than four years before retiring.
Justices Hima Kohli and Bela M. Trivedi would also spend less than four years in the top court.
Justices Kohli, Trivedi and Nagarathna’s entry marked the first time three women judges were appointed at the same time in the Supreme Court.
Their presence along with that of Justice Indira Banerjee is the first time the Supreme Court has four serving women judges

How Does HMPV Spread?

HMPV spreads primarily through:
1. Respiratory droplets (from coughing or sneezing).
2. Direct contact with infected individuals.
3. Touching contaminated surfaces like doorknobs, phones, or keyboards and then touching the face (eyes, nose, mouth).

Who is at Risk?
👉Children, elderly individuals, and those with weakened immune systems are more susceptible to severe infections.
👉People with pre-existing respiratory conditions (e.g., asthma, COPD) are at higher risk of complications like bronchitis or pneumonia.

How Are Symptoms Identified?

1. Cough, runny or blocked nose.
2. Sore throat, fever, and wheezing.
3. Complications in severe cases, such as bronchitis or pneumonia.

👉The incubation period is 3–6 days, and most cases resolve with rest and supportive care.

What is the Indian Government’s Stand?
👉The National Centre for Disease Control (NCDC) under the Union Health Ministry is actively monitoring respiratory infections, including HMPV and seasonal influenza.
👉Health officials have clarified that HMPV is not a new virus, and the country’s surveillance system is vigilant.
👉Recent cases of HMPV have been identified in infants from Karnataka and Gujarat.
👉Health experts emphasize the importance of preventive measures and public health awareness.

Way Out:
👉There is no vaccine or specific antiviral treatment for HMPV.

Prevention strategies:
👉Frequent handwashing with soap and water.
👉Avoiding close contact with infected individuals.
👉Wearing masks in crowded areas and when symptomatic.
👉People with underlying respiratory conditions should take extra precautions.
👉Strengthened surveillance systems and public health campaigns are key to mitigating risks.

### Critical Analysis of the Banking Laws (Amendment) Bill, 2024

#### Overview
- Purpose: Proposed by the Ministry of Finance, the bill aims to amend multiple banking laws to enhance the regulatory framework for the Indian banking sector.
- Key Acts Amended:
  - Reserve Bank of India Act, 1934
  - Banking Regulation Act, 1949
  - State Bank of India Act, 1955
  - Banking Companies (Acquisition and Transfer of Undertakings) Acts, 1970 and 1980

#### Key Provisions
1. Enhanced Regulatory Powers:
   - Empowers the Reserve Bank of India (RBI) to impose stricter regulations on banks to maintain stability and safeguard depositors' interests.
   - Introduces provisions for greater oversight on asset quality and risk management.

2. Resolution Framework:
   - Establishes a framework for the timely resolution of stressed assets, aimed at reducing the burden of Non-Performing Assets (NPAs).
   - Facilitates quicker recovery processes for banks, thereby improving financial health.

3. Corporate Governance:
   - Strengthens corporate governance norms for banks, enhancing accountability among management and board members.
   - Introduces measures to improve transparency in banking operations.

4. Digital Banking Regulations:
   - Addresses the growing digital banking landscape, providing a regulatory framework to manage risks associated with digital transactions.
   - Ensures customer data protection and cybersecurity measures.

5. Consumer Protection:
   - Enhances provisions related to consumer rights and grievance redressal mechanisms in banking services.
   - Aims to improve customer trust and confidence in the banking system.

#### Critical Analysis
- Pros:
  - Stability: Strengthened regulations may lead to a more resilient banking sector, protecting against future crises.
  - Efficiency: A clear resolution framework can reduce the economic impact of NPAs and enhance the overall efficiency of the banking system.
  - Adaptation to Change: Provisions for digital banking reflect the evolving financial landscape and the need for modern regulations.

- Cons:
  - Regulatory Overreach: Concerns regarding potential overregulation, which could stifle innovation and competitiveness among banks.
  - Implementation Challenges: The success of these amendments hinges on effective implementation and monitoring by the RBI and other regulatory bodies.
  - Impact on Smaller Banks: Stricter regulations may disproportionately affect smaller banks, potentially leading to consolidation in the sector.

#### Conclusion
- The Banking Laws (Amendment) Bill, 2024 represents a significant step towards strengthening the regulatory framework of the Indian banking sector. While it aims to enhance stability, efficiency, and consumer protection, careful consideration of potential overreach and implementation challenges is crucial to ensure the desired outcomes without compromising innovation or competitiveness.
